Hi VJ members! We are still waiting for our NOA2 at this point. cray5ol.gif To make the long story short,

NOA1 - July 26, 2012

RFE - July 25, 2013 - per uscis website

RFE hardcopy received in the mail - 7/29/2013 asking for proof/evidence of having met within the past 2 yrs

Note: This evidence was already submitted in the original petition paperwork but sure, we resent it (like we can argue?)

RFE docs submitted/mailed - 7/31/2013

2nd RFE - 8/27/2013 - per uscis website

RFE hardcopy received in the mail - 8/30/2013 asking for proof/evidence of having met within the past 2 yrs AGAIN! Yes, it's the exact same letter

Question to anyone who might have an idea, what's happening at uscis? is this normal? If it is, then please let us know what we can do apart from sending back the docs they require for the 3RD TIME. I know we have to practice patience and all that when we signed up to go this route but, please......this is just way too much....

What have you been sending as evidence? That might be the issue. Do your pictures have time-date stamps? Did you send copies of the passport stamps that you were in the same country? Bank statements that you used your bank funds while in that country? Pictures (date-stamped) of the 2 of you in front of distinguishable places in that country? It really does matter what you are sending them. A picture of the 2 of you on a couch could be taken anytime/anywhere - so that date-stamp helps

Just wondering did you include the rfe letter from the uscis when you sent the 2nd batch of proof/ evidences that you have met within 2 Years of sending the I-129f?....did you make cover letter with USCIS rfe letter and the proof or evidences?

This is crazy JBForever. You must be the last of us July 2012 filers!

Can you list precisely what you sent as proof of you having met in the last 2 years and then maybe we can give some advice. Sending exactly what you sent the 1st and 2nd time for a 3rd time is probably not going to get it moved on.

Did they receive your first reply to RFE? How about scheduling an InfoPass?

yes, they say they cant be sure its his passport and pics dont count. infopass before all this only got us no where. they basically just said they're swamped but when asked why are others that filed before us got approved, they say we cant prove that....

us citizen's passport w/ stamps of when he went to the phils in 2012. pics of when he was here. no date stamps as they were thru celphone, digital cam w/o dater. they said pics dont make us together w/in 2 yrs ago.

-DOCUMENTS AS EVIDENCE THAT APPLICANT & BENEFICIARY HAVE MET WITHIN 2 YRS
- Copies of my fiancee's passport with stamps as evidence that she came to visit in October 6, 2010.
- Copies of my fiancee's boarding pass, itinerary and plane ticket going to the US
- Photos of me and my fiancee whilst she was here in the US
- (PETITIONER/APPLICANT)passport's page copies showing on the next page the stamp as evidence that he went to the Philippines on 3/28/2012 to visit fiancee and attend her daughter's 18th birthday.
- Photos of me and my fiancee whilst i was there in the Philippines
i honestly dont know what else they want. i dont even know if they realize we have been waiting for this approval for more than a year now.

What did you send?

Gosh!. Sometime we just don't know what they mean 'evidence' though we sent them what we thought those things are 'evidence'. cray5ol.gif

Passport stamps and boarding passes are usually all that are needed, backed up by things like receipts and pictures.

But they are saying that they cannot be sure it is his passport, so this tells me that perhaps he didn't send in this proof properly, not that they wouldn't accept it as enough evidence.

To properly send in the above evidence, you need to do the following:

Provide a cover letter detailing each visit that you are submitting proof for, explaining who exactly went to whom to visit, the dates, where it was, and what you did during the visit.

Provide definite proof of each visit:

1. Copy EVERY page of the passport, even the front and back cover, and especially the passport bio page. And circle the actual passport stamps, so as being sure to point out the date and arrival/exit locations.

2. Provide boarding passes for every entry exit, again circling the pertinent info on it, such as names and dates/times.

Since this is going to be the third and last time, as they will deny after this if they are not satisfied, I would have him send in the actual passport (along with the above proofs). Maybe yours too. They are saying that they cannot be sure it is his, so why take chances? If he loses his passport over this, or doesn't get it returned, he can always get a replacement. It may be worth the money than to suffer a denial.

Send in the email booking confirmation for the trips with email addresses and everything (I know you said you already sent them itineraries, so maybe we mean the same thing), and if I were you, I'd have friends and family write letters to put in the package. In those letters just have them state their relationship to you (or your fiancé) and have them write something about how they met the both of you together in the respective country. Make sure they add their contact info. Have them give it to you just like that with their signature or tell them to email you their statement and then just print that out.

thanks for the tip everyone. I sent him all your advices. i had him send in my visit from 2010 with complete details of boarding passes (he already threw away his since its been a year), plane ticket and itineraries including our photos together. i was concerned with what Leon said. The 3rd RFE would be our last chance? otherwise they'd deny us? coz right now it is the 2nd RFE they sent for the same thing. Does that mean we still have a chance? or this 2nd RFE response is our last chance to have them approve our file? He had all pages of his passport scanned and sent even the first time as it is used as his proof of citizenship as well. I dont know what they want from us. I was thinking he could go directly to one of the local field offices and show them his passport and have them vouch for him that it is indeed his.....i am totally at my wit's end.
