It is just amazing how after reading the advices here I went to Walmart to print the pictures of my visitation to send them to Texas Service Center. I ran into a friend who asked me about how things were going. Without giving much details, my friend told me he was glad that I already filed. He also told me... and this is the part that pushed my faith even more... he told me: "Put that petition in God's hands. No matter what conditions, difficulties, requirements, problems, or whatever, the case will be processed by God through the immigration department".

Except that petition won't get to "God's" hands because it will only be handled by an adjudicator and that guy won't be touched by divine intervention, so I'd go ahead and follow the advice of the countless people that have already posted.

I love a guy who looks like he could be on Criminal Minds as either an agent or a killer.

Well on the plus side took some searching but i so remember this happening with another VJ member. Everyone said no way to her also.

One thing you have on your side is you at least have met. This isn't a "We never meet we want to skip that part". Hopefully you wrote a good enough waiver to state you case.

Amazing! Thank you so much! I'm digging that post right no and I gotta say that my hopes have been doubled up. Some of their struggle applies to me, and I didn't even know I USCIS would even listen to some details on my hardship after I ended up alone raising a newborn. He was 6 month old without a mother.

Now that I remember. A lawyer helped me to become a U.S. Citizen. He saw my struggle and didn't charge me a penny. I owe him so much for this since he even filled for the Citizenship fee waiver. He explained it was a long shot, and many people told me they would make me pay the last penny on that fee. However, I believe and I'm sure that it was God through the person who reviewed the waiver. It was approved.

Even assuming that everybody at USCIS and at the embassy oversees the lack of one of the requirements and she gets a visa, what happens if a few years down the road at the AOS or ROC or naturalization stage some immigration officer finally realizes that there was a mistake in the first place?

Why does everyone assume the waiver would be denied. he submitted a waiver people. They have meet and had a child. people have been approved meeting and 2 years have passed before.

Secondly, Why do you assume if they get approved there's this dark cloud of wrong and it will come and get them. If the waiver was approved and they move on hey they move on. This is not a miss queue from USCIS.

Dang where is the encouragement and the "you know this could happen". shish...SMH

I must have missed the part where they filed for a waiver. It was my understanding that they are hoping for a miracle. Generally I tend to hope for the best but prepare for the worst. And given what they have endured so far (read their story in the link in their signature block), if I was in their shoes I would do things properly and follow the law by the letter. There is no reason to add any more hurdles.

He... big question now... how do I actually file for a waiver. All I did was a letter explaining our situation.

I submitted that expedite request a little before I went to Guatemala. It wasn't the porpoise of my call to USCIS, but it came up while talking with the representative. I mentioned that I was on risk of loosing my job over this trip that it ended a week sooner than planned. Here is what I got.

I did not see any part of this thread where it stated the OP filed for a waiver to get out of meeting in the 2 years prior to filing. They have a denied expedite and were asking if sending the proof of meeting that happened months after filing will be matched up with their case and get them approved, even if the meeting was not within the 2 year requirement.

Even if the waiver was filed, waivers for the 2 year meeting requirement do get approved sometimes, but it is rare and not the norm.

Exactly. And considering that they did meet in person one month after filing, I am afraid that the waiver will not be granted. No harm in trying, but I would really REALLY consider refiling properly instead. This said, I think the OP has received enough advice on how to handle this, there is nothing else to add. Good luck to the OP.
