i am considering bringing both my parents to live in the US. they are planning to come for an extended visit. can i file both I130 and I485 conurently, while they are here? can they go back to their home while processing is pending? lastly, i am confused as to the filing location: the I130 would direct us to chicago, the 485 to phoenix. would greatly appreciate your help!!

It would be immigration fraud for them to use the tourist visa with intent to immigrate/ stay. You can file the I-130 while they are here, but they must go home and have their medical and interview there.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

that is the part that was unclear to me: the uscis specifies that you can file concurently both i130 and i485 for somebody already in the USA; who would this apply to? i am just looking at at options and obviously have no intent to do any kind of fraud. thanks

Someone who entered on a visa allowing dual intent would be one example.

If your parents come to the US on a one way ticket with all their valuables in their bags chances are they will get turned back and their visas with be revoked. You can file NOW for them and they can visit during the process. The process usually only takes about a year. Trying to take shortcuts could result in lifetime bans. Trying to co file does not eliminate the need to affidavit of support or providing proof of medical coverage and increases the chances of problems.

This will not be over quickly. You will not enjoy this.

This, or if there is a major and unexpected change while they are in the USA. Say they planned to come visit for a month, and then while they are here, civil war breaks out at home and it is not safe for them to go back, or you have a major accident and will need help for months, maybe years, and so they need to stay to assist you.

All that would need to happen is that they change their mind, no need for major causation.
