Hello, I am in need of advice for my situation. My wife and I were engaged secretly for over a year, because our family did not approve of the relationship. We were both arranged to get married to different people. However my wife’s Green Card came from her brother this year. he is American citizen and he applied for her many years ago. So, I applied for a VISA. I got the B2 visa, and we came to New York two months ago. We are staying with her brother. We left everything and eloped and got married at the court house. Now we cant go back and we want to start a life here in USA. She is a nurse, and I am a Software Engineer, so I am sure we can make a good life and become good society members. We went to a immigration lawyer for a free consultation. He said I could get my Green Card through my wife. However the fees he is charging to do the application is very high, and we can not afford it now. So what do I need to do now in order to start the process myself? Thanks for all your help.

Did you enter the US with the intent to immigrate?

Look at the Guides at the top of this page. This is a Do-It-Yourself forum, so you will be doing a lot of reading researching the requirements.

You do realize that your wife has to file an I-864 Affidavit of Support, right? Since she just got here and presumablly has no income, you will need a Joint Sponsor. You will need a US citizen or LPR who makes enough to sponsor you. There are no exceptions. You will need a Joint Sponsor.

Yes, her brother can be the sponser, he said he will help us. He has a good job can qualify for any credit

How is OP's action not committing immigration fraud when he clearly stated that he entered the country on a B2 visa and now he wanted to stay and get a derivative status through his wife?

Everything was planned ; from getting the B2 visa, to eloping, to having his wife's brother helping him to stay in the US.

I said get yourself a lawyer and maybe consider asylum.

asylum based on what? There has to be a reason for it.

The OP's wife can file the i-130 and he can return home to wait for the process to take it's course instead of adjusting status, if there was intent to adjust before entering

The OP has a perfectly legal path to US residency right now. There is no need for him to chase bogus asylum claims. The result would be the same, that he stays here, so the path of least resistance is to adjust his status, now that F2A is current.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
