Visa Denied due to moral turpitude, can apply for i-601 waiver

Received letter dated 8-26-2013 stating Visa denied due to moral turpitude - misleading a police, we can apply for a waiver I-601.

What is the best way to do this waiver? What do we need to put in the section which states why he should be allowed the waiver.

He had accident in 2007 where he was dumb and decided to lie and now he has done everything lawfully and abided and done what the judge ordered him. But this now leads us here. I need him to come to California so he can live here with me and get married here. I have a huge family and they cannot travel to Canada, I want him to live in CA forever near my family and he is fine with that. he has to be able to cross the border regardless to come and marry me and see my family and friends, my life here! he knows I am too close to my family and obviously CA is much better then Canada to me. I don't know what to do? please help and guide me. I am having the worst years of my life not knowing when to plan for my future and my wedding. please help!! I don't want to move there!

11-25-2011 - NOA1 - Applied for K-1 Fiancee Visa for my Canadian love living in Vancouver from Pakistan, sent package to California
04-23-2012 - NOA2 - Application Approved, waiting for interview date.
07-23-2012 - NOA3 - Email from Vancouver consulate that we are receiving letter to send packet 3.
07-23-2012 - NOA3 - Packet 3 - Letter received to submit DS-230 and Checklist to get a interview scheduled.
12-07-2012 - Interview - Received white paper requesting more documents.

04-10-2013 - Sent additional documents via Loomis for Van Consulate.

05-10-2013 - Email stating passport is at Loomis for pick up.

05-13-2013 - Passport returned requesting 1. Police Reports which we have previously submitted 2 times and also stated 2. Administrative Processing.

08-29-2013 - Received letter stating Visa Denied due to Moral Turpitude, Also note that we can apply for wavier I-601

12-31-2013 - Receipt date for I-601 Waiver - Waiting for results.

07-10-2014 - Interview, Visa Approved, Administrative Processing.... waiting....

8-1-2014 - Visa Issued

11-18-2014- flight booked for Fiance

1-2015 -Married, Registered for SSN, Registered for AOS, Work Permit and Advance Parole

10-2015 - AOS interview, approved.

Approximately 4 year journey to get everything done.

 

8-2017- Filed for Green Card - USCIS I-751 Petition (Form CRI-89, Petition to Remove Conditions of Permanent Resident Status )

 

Waiting to hear back on getting a Green Card....

If you can apply for a waiver, the consular officer at the U.S. embassy or consulate where you applied will inform you how to apply.

Immigrant Visa and K Nonimmigrant Visa Applicants - If you can apply for a waiver, you must mail Form I-601, Application for Waiver of Grounds of Inadmissibility, directly to a U.S. Citizenship and Immigration Services (USCIS) Lockbox facility, with few exceptions. Learn more on the USCIS website.

but it's better if you could talk to a lawyer

Waivers are not a DIY thing at least consult with a lawyer,

you have to show ongoing relationship, hardship to you if

fiancé cant move to CA, ties to your family and community

(church, volunteer etc) and a good job you cannot leave to

live in Canada elderly parents you have to live close to ...

all this will need evidences from reputable sources...I601

is not just filling out the form and getting approved.

Canadians seem to have good approval rate if its a non

violent crime...it seem like a lot of work but best you speak

to a WAIVER attorney good luck...check immigrate2us

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

thanks guys! I know I have to contact a lawyer to help me really appreciate the feedback. does anyone know any good lawyer in Orange County, CA? also can my fiancee get a lawyer from Canada and have him do it or does the lawyer need to be from the U.S. for better results?

Does anyone have sample letters or writings of the i-601 that people have sent in? I want to just see how this stuff looks and works.

lastly how much is the average rate for lawyers? does anyone have info for me this is the first time dealing with a lawyer in my life. thanks!!

he did not spend any time in jail, he had to do community service and house arrest but he did not have a brace or anything on his foot just orders to go to work and stay home, it was for 6 months.

I am having a difficult time contacting a attorney, I called one 2 times no response back.
