As long as you're above 3 times the poverty level with assets, NVC should accept your AOS papers. You may get a false checklist saying they've accepted it, but you may need a co-sponsor for the interview.

Consular Officers are not obligated to accept anything. They pretty much have their own rules and can do what they want. Sad, but true. Should they accept it? Yes. Will they? Who knows. Only time will tell.

My advice: have a co-sponsor lined up with all the necessary papers and bring that to the interview. If for whatever reason the CO doesn't like your AOS paperwork, you can then present the co-sponsor paperwork without any delays.

thank you, I do have a cosponsor lined up if necessary, but will unfortunately risk it for personal reasons right now. my wife is young and has good work history, so I am hoping that with the assets will be good enough.

my nvc case is complete.. I didn't get a checklist for this, but it was written that I may need a cosponsor and it will be sent to the embassy for final processing. when I spoke with nvc, they said they put that statement in due to the fact that they do not consider assets, just the income.

thanks for the quick response

Good, you're prepared good.gif Hopefully the CO will accept the assets. But, every consulate/embassy seems to have their own guidelines, so you just have to wait and see. Good luck!

So called NVC today and she said they reviewed my IV yesterday. She also informed me that effective yesterday all persons now have to submit form DS-260 and now although mine had been sitting there since August 8th and that my instructions that I received after paying my fees said that if my case # number did not begin with certain letters that I had to submit form DS230 which I did. How is this possible that this could happen and they not mention this anywhere on the state website. So frustrated right now, cant even put it in words!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! OH and I dare not forget her words, "I guess your one of the lucky ones".

HMMM how many times have you said this lol... poor dude

LOL once I moved here I haven't brought it up once to him. Just use it as a tool on the forums to show you can submit the AOS after the IV ;)

Spoke to several different operators today and they all say it is now world wide. I just cant see that they will not honor DS 230 that have been submitted a month ago and sitting in their mail room, but they say no. Also there has been no mention of this anywhere, I have not seen it in the NVC thread or on the state website. Below other forms it notes that they are no longer acceptable or are acceptable for a certain period but nothing on the DS 230, this is the part that really upsets me. Lady also told me that had I submitted the DS 260 and they reviewed it before September 3rd they would have rejected it so I guess no win situation I just hope people find out and don't find out at the end when I did.

It was on the forums about the online forms but you're correct that they didn't really let everyone know via their website, at least that I can see. However, online forms are SUPER easy to do! You still have to send in the documents so if your mail is already there, you're a step ahead.

I am not sure what you should do, they reviewed my 230 yesterday and although I haven't received checklist I submitted it under the direction of NVC.

They told me it would take another 20 business days to review but when I submitted the DS 260 online it said thanks for your application it has been forwarded to NVC and will be processed in 3-5 business days. IS anyone here familiar with electronic processing of the DS 260 and how long on average it takes?

The NVC seems to be transitioning toward an all electronic process. If the NVC is in a state of flux right now, it will be hard for anyone on here to give you accurate advice. I would follow the instructions they provided you and send the DS-261 - they know where your application falls in relation to the transition. I suspect some people are going to be caught in a phase between the paper processing and electronic processing, so there will be plenty of confusion in the coming weeks.
