NVC Filers - September 2013

Hi NVC September Filers!

A friend in the September fliers recommended I come join you guys since I got my NOA2. I can't really believe I'm here already, because we only filed in September, as you can see from my signature. This has happened FAST....like 3 weeks from sending in the petition to receiving our response. I am grateful. But, now I feel there is a steep learning curve about where to go from here.

Thank you, Ryan H, for the great information page at the start of this thread. We have been reading through it and I think I get the next steps to be the following:

-Hubby (beneficiary) is now obtaining his Police Records from his countries of residence. (He has lived in more than one as an adult)

-I have requested tax transcripts & a verification of employment & plan to print some check stubs (I'm not sure whether I really need a year or my most recent when it's requested)

-The NOA2 tells me to wait 30 days to call NVC, but, from reading on here, it looks like I should begin to call next week. Is that right? I'm not sure what to do there.

-We understand that we can not file electronically because we're not one of the locations listed on the "Establish Communication w/ the NVC" page

I have no idea what to expect really at this point as it has just happened. Any insights from you guys would be helpful and appreciated! star_smile.gif

For pay stubs, you don't need a year's worth, especially if your pay stubs have a YTD (Year-To-Date) column. If they do, then you really only need the most recent stub. If they don't, then just 3-6 months is sufficient.

Yup, NL isn't eligible for EP, so snail mailing packages is your only option. But, with the new policy change September 1st, you can do two forms online now: DS-261 and DS-260. Click on the last link in my signature to read about that.

Saylin, (if we meet these 3 criteria) can form I-864EZ be used with a joint sponsor uses I-864? or must 2 forms are I-864?

When it comes to have a joint sponsor, I think there's a divide here on what to do. How I interpret the criteria for the I-864EZ (about qualifying only on your own earned income) is that if you can't qualify on your own, then you aren't eligible to use the I-864EZ, thus both the petitioner and joint sponsor have to use the I-864 form. While others take it as the petitioner can still use the I-864EZ if they qualify, even with a joint sponsor. So, it's up to you.

Do I need to wait to start the DS-261 or 260 until I have a number from NVC? I thought, for some reason, that I did.

I won't need to use a co-sponsor, so I probably can do the easier form if that's required.

Thanks again for all the links and info! This process is unravelling mighty fast for me. While I'm happy, it's just a lot of paperwork to be sure we have together really quickly...

I have a question for those that seem to be very knowledgeable on this thread! I posted in the general inquiries forum for IR1-CR1...but no one has really answered my question. And, I have a few other questions I didn't think of until now. So please help!

Is it absolutely necessary to submit all three years of tax returns/transcripts? I know the form just says 1 year (2012) is mandatory but I wasn't sure if they could send me back a checklist for not including 2011 and 2010. Also, if it's optional to submit the other 2 years of tax returns, do we need to still write in our total income on the I-864 for all three years? If I only know the adjusted gross income for 2010, can I just use that?

On the I-864 for part 2 where it says Mailing Address (2.a through 2.h) is that where the beneficiary lives or where I live? Because I thought it was supposed to be where he lives (outside the USA), but there's an example of a completed form on this website and it shows as if it's the petitioner's USA address.

Last but not least, I saw someone on here who got a checklist mailed to them for not putting N/A for a field. Am I supposed to put N/A in all fields that don't apply to me?

Sorry so many questions but I appreciate any and all advise! Thanks!

From what I have seen lately, it seems like NVC sits on them for 20 business days or so before mailing (at least in a few cases). Other times it's been faster. In our case they misplaced our petition and it took a while to locate it.

The point is, there's no real way to estimate this step as everyone seems to be handled differently.

The DS-260 only becomes available after the IV bill has been invoiced, so yes, you need to wait. The DS-261 becomes available a few days after the case number is assigned. Plus, you need a case number to even log into the forms portal, so yes, you need to wait. Otherwise, how would NVC know who's filling out the forms? Everything requires a case number,

No, NVC only requires the most recent year, so if you don't want to submit all three, that's fine. Keep in mind though, the consulate/embassy may require all three years, so I highly suggest you bring all three years to the interview if you decide not to submit them all at NVC. Whether you choose 1 year or all 3, you still need to write in all three year's information on the form. Why don't you just request the tax transcripts from IRS for the three past years? It's completely free and NVC actually prefers tax transcripts over the tax forms.

Part 2 is about the immigrant, so yes, it's the beneficiary's address.

If it applies to you, but there's no answer, then put 'none'. If it doesn't apply, then put 'N/A'. Make sure no field is left blank, otherwise the officer can think you forgot to fill it out and issue a checklist.

Looking at your signature, your IV package was accepted before September began (and when DS-260 was required by everyone), not to mention your case is completed, so it should be fine. I'm assuming NVC just made the DS-260 available to everyone, whether they need to complete it or not.
