I'm very new to this and need some guidance. I'm planing to get married to a Thai girl in January 2014 and I'm planing to file CR-1 visa for her to come to US. A family member of her told her that I can file DCF in Thailand even though I don't live there - But I will be in Thailand for 3 weeks for the wedding. Does anyone know if this is possible? Can we file right after we got married?

Also, can my fiancee file for a tourist visa now and then file for CR-1 after we're married? We're not planing to get married in US, just a visit.

If you haven't done so find the book Thailand Fever on Amazon. Buy her a copy too or have her find it in Thailand where it is sold in many stores where farangs shop for books. This is very important especially if you will marry in Thailand. You will want to understand the concept of sin sod for example. Ask questions here on V J about this or any other subject.

Make sure you learn right now that every Tuk Tuk driver and family member live in a fantasy world where they are all experts in immigration matters. Those experts haven't every actually had any experience of course.

You can not use the DCF method unless you have been a legal resident of Thailand for at least 6 months. That means you have to have the right Thai visa to do so.

You can file the C R 1 petition right after you marry.

Your fiancée can apply for a tourist visa at any time. These are very difficult to obtain. She must understand the strongest ties rules and be able to prove beyond doubt she MUST return. The outcome of this will have zero affect on the C R 1 but if she tries to get a tourist visa after you file the C R 1 she will be denied a tourist visa. If she did get a tourist visa there would be nothing wrong with marrying in the USA as long as she returned to Thailand.

Thanks for the info - But I should say that I'm also Thai National but now US citizens because I came here when I was 10 yrs old, now 35. I wanted her to be able to visit me while we wait for CR-1 visa. We are definitely NOT getting married in US because we already booked hotel in Thailand for a wedding over 200 ppl. I hope that she will be able to get tourist visa because she has been working well known company for 7 yrs, home is also under her name. I'm hoping to maybe have her come spend some time here after our wedding. Too bad I can file CR-1 there, really to this process to go quick.

Just thought of something, I guessing I'm a dual citizens - does that make any different?

Thanks for the info - But I should say that I'm also Thai National but now US citizens because I came here when I was 10 yrs old, now 35. I wanted her to be able to visit me while we wait for CR-1 visa. We are definitely NOT getting married in US because we already booked hotel in Thailand for a wedding over 200 ppl. Yeah it would have been nice to tell us you are a Thai.

She wont know about the tourist visa until she interviews. I wont waste time explaining again what she must do to try to get one. If she uses the reasons you give she will be denied. When they see why she wants to go to the USA she will be denied.

You CAN NOT file a DCF there. You can file the petition by mail from there if that's what you mean.

This process will never " go quick" no matter what you do. This process takes time. Plan on at least 9 months to around 12 months. USCIS is working on about 2.5 million cases. BKK sees 700 per month. Yours will be just one of those.

Dual citizenship means just that but changes nothing when it comes to your situation in regards to immigration.
