Well, I guess we are really in the same boat!

I called again today... the same I do every day, but their answer never changes. "Your file is under administrative processing and it could leave at any time. K1 Visas are usually sent out quick.. blah blah blah...and that since visas are always available for these cases that is why we can't give an approximation of when the file could be sent, but it could be any moment"

I asked them if there is like an internal system in which they process this date and they are done and continue with the rest, but they told me no. And that it has nothing to do with priority date or anything...

I don't know what else I could do... I have e-mailed them, but no answer after 2 weeks.

I call them on a daily basis... I always get the same thing.

I check the status online... still says at NVC

And in addition to that the NOA2 issue is driving me crazy.... Now they want me to wait 15 more days.

I am fed up!

Loran - Let's send some prayers up for each other and hope we get unstuck from NVC before the weekend! Perhaps they just have a large backlog of cases? Is there some sort of additional checks that they perform at NVC that you know of? I thought it was just them packaging it up and sending it off to the Consulate, sort of like a clearing house.

That's what I thought, but then i read somewhere that they have a fraud prevention group that checks certain petitions to make sure they are not a fraud case.

So basically I have no idea of what may be happening with it. Either they are still putting stuff together or they chave chosen our files for fraud detection.

I see. I had not heard that. Well I dont know how they determine that, but I guess its just part of their process. I have already been twice to Kazakhstan for a visit in 6 months, and this was very expensive. We talk on the phone 1-2 hours every day. You don't spend that kind of money unless you are crazy in love! So in my case there is no way they can ever say fraud lol.

This process is just crushing. I cant wait for it to be over so we can finally be together. I'm sure you are feeling exactly the same way!

Don't worry guys I am sure it's just all random pickings kind of like a audit where every few files gets audited. Don't stress. I was under so much stress over my medical today I broke out in a spot. Then when I got there today realised I was worrying over nothing.

I believe it's the case with you guys. Even if they make checks as long as its all legit there won't be a problem.you will be fine just trust in god. And remember at any stage of this process we can go in to AP. we shall breath a sigh of relief when visa is in our hand. My prayers are with all of you.

Thank you so much for your prayers, and sending some your way as well. It truly is out of our hands, you are right. No doubts in my mind its going to happen, its more the when that is driving me bonkers. I think the other issue for me is that I had a false impression that once it went to NVC it was already researched and approved and just needed to be shipped off, so it would only be a quick pitstop at NVC, not another hurtle to go through.I'm sure in a few weeks from now I will be smiling and my sweetheart will be in my arms again! :) Thanks again for the positive encouragement.

Ok yes I sent the forms 2nd of may via next day express to Texas and received noa1 7th may. I flew from atlanta back to London that same day. Approval in 2 months 3 weeks. I thought I would have a longer wait but luckily no rfe and I don't know but I feel what might have helped me to get approved quickly was the photocopy of my sons US passport as a extra . I sent it to them with the forms to show he was born in Atlanta Georgia and since been born we have made 3 trips there. That may have helped us a little cant be positive about that but I feel it did.

It is funny how we have the same time line but somewhere along the process the gap widens. I guess it all depends again on who pick up the file and how quickly they are getting through their pile.

Thank god we are close. I feel yours will be over soon. Positive thoughts.

Individuals applying for an immigrant visa may find that their cases have been placed in Administrative Processing for one reason or another. They are neither denied nor approved as additional time may be needed to make a determinative response in the case. This decision is made after the visa applicant's interview by a consular officer. Most administrative processing is resolved within 60 days of the visa interview, however, when placed in administrative processing, the timing will vary based on individual circumstances of each case.

In immigrant visa cases such as the K1 fiance visa, a consular officer may conclude at the end of the interview that there is simply insufficient evidence to approve the case. The reason may be that new evidence was discovered during the interview that raised a red flag, or an administrative discrepancy to warrant a secondary review. A visa case requiring additional administrative processing may take months to conclude, however, in this writer's experience, providing additional compelling evidence of the bona fides of the applicant's relationship to the American petition may assist the officer in making a definitive decision in the case.

Administrative processing is a state of flux that leaves a visa applicant frustrated and confused as there is no definitive guidelines as to what the immigration issues are and whether the applicants can do anything to compel the proper agency to respond. Additionally, it is within the discretion of the interviewing consular officer to place a visa case in further administrative processing as the Foreign Affairs Manual (FAM) provides ample guidance for officers to exercise this power based on their factual finding.

Whether the case is outright denied or placed in administrative processing, a visa denial applicant should consult with a competent immigration attorney to review the case and provide the best course of action based on the applicant's unique sets of facts. Consular processing attorneys are in a highly advantageous position to assist since they are able to inquire directly with the consulate and embassy where the applicant's case was denied.

Loran:

My status just changed from AT NVC to In Transit. I am sure yours will be coming right behind mine!! So keep the faith. Mine has been NOA since July 29, so yours is about the same timeframe.

Hugs! We will get thru this :)

Thank you for that but it really does not help me much.
