Hello,

I was wondering if my wife can change her status from F1 to a pending status( don't know the exact status). We have already received NOA1 for I-130 and I-485. She is graduating this december 2013. I don't want her to apply another I-765 (opt). What should she do in-order to change the status from F1?

Please share your experience.

08/01/2013 : I-130, I-485 and I-765 sent.


08/07/2013: e-mail and text received from USCIS.


08/12/2013: received hard copy.


08/22/2013: received hard copy of biometrics for 09/06/2013.


09/06/2013: Biometrics done


09/11/2013: I-485 status changed to 'testing and Interview"


09/23/2013: Received text and email- EAD in production


09/27/2013: EAD card mailed.


09/30/2013: EAD card received. Still waiting for Interview date.


12/23/2013: Interview scheduled for January 29,2014. Waiting for hard copy.


01/29/2014: Green card approved and card in production. dancin5hr.gif

until the green card is issued, she'll still be on F-1 status.

To maintain that F-1 status, she'll need to be in school.

However, if she dropped out of school today, she'd be in a different type (and period) of authorized stay, as you have the receipt notices already on the stuff you've filed.

So she graduates in December - lets say she maintains her F-1 till then.

If you included the EAD ap with the big submittal , she'll get a new EAD card - usually 80 to 110 days after the filing date - so at least she'll have the EAD card by the time she graduates. Good news, right?

After she graduates, if she does not take the OPT period, and lets say she doesn't - she's still in the authorized stay period for the Adjustment of Status that you filed. Ultimately - when the green card is issued - all is cool again - any period of overstay is forgiven when the green card arrives (automagically) ,,

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

If you filed I-485 then you already have filed to change status.

I suggest you remember what you have filed for.

Thank you for your response. I am GC holder and i filed all the paper work in August,2013. So, my PD is current as of August, 2013.

I did not get the second part that you asked- " suggest you remember what you have filed for".

08/01/2013 : I-130, I-485 and I-765 sent.
