Has anyone been Denied a k-1 visa and during the Interview they Revoked the existing B2 Visa under 214(b) and p6©i and come back and obtain a successful CR-1 Visa?

Revoked the B2 why? Thats not good. Need to know all why you were denied before applying for CR1/IR1.

i would view the b2 revocation as a singular event - for when the k-1 visa interview goes through - and beneficiary found inadmissable per k-1 adjudication rules, all current visas in passport are revoked. That's normal procedure (but I can't quote the 9 FAM reg about this, sorry).

IMO (and yours) the K-1 denial was solely due to the Vice-Consul not having her trip records in front of them for the trips she made to see you.

As to 'who else has this happened to' - unsure - I vaguely remember something a few years back , they did what you did - got married, filed for CR-1 and were successful.

I know you front loaded the petition - but I suggest you sideload the same stuff plus more stuff with the DS-230 submittal, utilizing EP when the casefile hits NVC.

Also IMO, a letter of attestation about 'what the VICE-CONSUL failed to see' should be useful, somewhere along the way. (I-130 submittal, DS-230 sideload)

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Travel Agency that Handled her Tourist Visa felled to list my name on the application as someone she knew in the United States,But she did list my name on the Original application that she gave to the travel agency. K-1 Denied for no relationship..The Embassy never looked at any of the Evidence that she took to the Interview. We didn't Frontload the k-1 either..ahhh!

Front-load the CR1 and sideload at the NVC to make sure all that information on your relationship is in the hands of the consular officer before the interview!

Yea Darnell,My Lawyer said he doubt's that the revoked b2 visa, would even come up at the cr-1 visa Interview.

The revoked B2 visa won't likely come up, as it is standard procedure to cancel a visitor's visa (a non-immigrant visa) when there are clear imminent plans to immigrate -- like the visa interview. (You can have dual intent -- a pending petition and still have a visitor's visa, but once it reaches the visa stage, you clearly intend to immigrate in 6 months or less, because that's the maximum validity of the visa).

What will come up is the P6C1 -- doesn't sound like leaving you off the first application is sufficient for the interviewing officer to find your fiancé committed fraud/material misrepresentation. You need to be sure there's nothing else that needs to be addressed, to make sure you cover it.

Hi,Thanks for the responce. The only other thing i can think of is,When they asked her how long she had known me,she said 1 yr.(it had only been 9 mos.),Then he asked her ,where is he now,I like WRONG Answers.

Also, maybe he thought she obtained the tourist Visa just to come see me,but that was not the case.I met her in Las Vegas ,with her tour Group. She never came to Alabama, where i live.
