DS-156: intend to work and intend to study

I have a question, especially for those who were approved. On form DS-156 when it asks if you intend to work in the U.S we put yes: with work authorization, employer unknown. When it asked if you intend to study in the U.S we also put yes: school unknown. My fiancee is worried that at the interview this will make it look like she's only coming to the U.S. to work and study and that our relationship is not genuine. I think that it will look suspicious if we say no because the intent with a K1 is that you adjust status to permanent resident and of course she will work and study in the U.S. in the future. Did anyone else put yes for either or both of those questions and get approved? Did anyone get denied because they answered yes to either one or both of those questions? Thanks in advance for your replies.

My fiancee has another question she wants me to ask. I have much better internet than her, so I filled out DS-156 for her and signed at the bottome that I prepared it for her. Will this bring up any red flags at the interview? Has anyone been denied for doing this? Has anyone been approved that has done this. Thanks again. As the interview date gets closer (Sept 10) my fiancee, and I, are getting more and more nervous.

It's ok that you both checked intend to work and study. Also it won't be a problem that you filled the DS156 for hee. Just make her familiarize some of the info on it as it may be a question at the interview. If they asked why you prepared it then just say bc she had bad internet connection.

Review your docs that they are completely and correctly filled out and you'll be ok :)

My fiance wants to know if that was how you answered those questions. To see if someone got approved answering the same thing. Sorry if that's too personal you don't need to answer. Thanks for your reply.

Your not going to be a public charge so they know you will eventually work or go to school or both depends in you. So you tick yes to school and yes to the work and write with work authorisation employer unknown. Your not going to be penalised for that it is essentially what every one writes and people still get their visas.

Hi Jared619! I prepared the all the docs for my fiancé's USEM interview. I researched how to best answer those documents (VJ sample forms included) and this is how I answered question 32 in DS-156 : Fiance applicant, will apply for work authorization. As for question 33, it really doesn't matter if you tick no for now and if your fiancee does decide to further her education in the future, the government will not hold it against you guys. And since you were the one who prepared the docs, you have to fill in all the information they asked for in question # 40, and don't forget to sign and date it. The CO found all his documents in order and now we are awaiting our visa. Goodluck guys!

I didn't answer like that as i finished my school in PH and will only need to work in the US but like the other posts, they will not deny just because you want to work and study. Haha! That's silly since it is very common here in the US that people would work and study. Just because you want to make a living doesn't mean you love the person any less. :) Good luck! :)

Its not an issue to put YES to working or studying once in the USA. Totally acceptable.

And it's not an issue to assist your fiancée with completing the forms.

All will be fine, no red flags with doing either of those things.

I've put "Yes. With work authorization, employer unknown." on that question, that seems to be fine.
I was worried about that too, but after researching, this seems to be the most common answer.

Good luck! good.gif

  • 2 weeks later...

I just wanted to updated this for anybody who might see it later. We did put yes on both questions and she passed the interview. They didn't even question her about it. They also didn't question at all that I filled out the forms for her. Thanks all for your replies.
