Hi everyone I have a very important question. I have a niece that is in Thailand right now with a tourist visa for 7 months now. She did not stay there for the whole 7 months, she exits the country before the visa expires, goes to Malaysia and then comes back, I don't exactly understand that kind of thing. But the question is.. does she needs police clearance from thailand for k1 visa? Thank you in advance.

Police clearances are needed for those who worked in that country. If she was a tourist she doesn't need one but I do believe that sometimes people who do the thing where they cross the boarder then go back has the tendency to have been working illegally or under the table.

If asked if she had worked there and has not then she doesn't need a police clearance. If she denies that she had worked there but stayed there for a really long time then they MIGHT ask her a few more questions to prove that she did not work there.

Tourist visa means she did not reside in the country; police clearance is needed from places where you resided for more than 6 months only.

If your niece lived in Thailand for 6 months or more she will need a police certificate. If she left and came back during her 7 month visit then she may not of lived there for 6 months.

The requirement is having LIVED in another country, doesn't matter what type if visa they were using.

h. OTHER COUNTRY POLICE CERTIFICATES. Applicants aged 16 years and older must also present police certificates from other countries where they have lived for six (6) months or more after reaching the age of 16.

I think you mean "she does not need a police report" instead of "she does not need a visa."
