had our interview yesterday in mexico. we were expect to be told to get a waiver for her over stay that ended in 2009 giving her a ten year ban. we were denied ubder INA §212(a)(6)©(i). and also for the over stay. the box for no waiver is also checked, the papers says a to 10 year ban starting jan 2009. After reading about INA §212(a)(6)©(i). it reads like there should be a waiver.

I have no idea what they think was misresprented, and if it for something on the ds-260 or other forms we filled in would the ban not have started yesterday?

she was honest on the forms about the overstay, I filled out most of them with her and nothing was hide or untrue.

I'm going to an attory as soon as im back in the states, but for now I am hoping for some education and some hope.

can anyone tell me what may have happened, and if there is hope we can get this over turned, waived, correct, anything!

She has no criminal record in the US or Mexico, she over stayed a tourist visa for years leaving 2009 on her own (not deported, no interaction with Immagration, just left). She has two small girls that were born here i the US, they live with her in mexico.

she asked then to explain the misrep. but the interviewer told to just get a lawyer and didnt say any more.

They reviewed our packed and kept her birth cert, look at my pay roll and financial things, and took the DS-156 and 156k and kept them also.

I understand this will take a good attorney, I'm just wanted advice and information, the more I can learn the more I can help the attorny, and the better understanding I'll have when we talk. plus I need anything to give me some hope.

Could this be related to how she obtained her tourist visa or to when she entered the US. Maybe incorrect information on the tourist visa application? Or did she do some sort of misrepresentation when she entered the country?

I dont not know, because her family help arrange the visa before and she does not have any of the paperwork any more

Maybe she not tell you all the info. if I was CO I ban her to because she over stayed an had kids in the state it look like she trying to get back in USA. just my view. And it could be have she got back to Mexico by force or herself.

What are you saying? I don't think she is the only person who over-stayed & had kids

and of course she is trying to get back in that's Y her husband petitioned her..enough

already.

OP there may have been some misrep on her initial application was she an adult or

did her parents bring her in/. When she departed the US in 2009 she did trigger a 10

year ban.....Don't stress too much get a good WAIVER attorney to talk to, they R the

experts and some offers free consultations it may take time and patience but don't give

up for those 2 little girls sake Papi...God is standing by.

OP as CO suggested get an atty...seem like ther may be hope there but COs

cannot furnish certain things upon denials..saying get atty definitely not a bad

sign but might be a long process be prepared
