ok, sorry for the confusion. She has a student visa for 5 years but only one year left to finish her degree, which she started in London. She was in the US last summer on a tourist visa, we travelled and decided to study in Seattle where my family lives and she applied for school there. We planned on going up to Canada to get her student visa there, the school said that would be possible. During the summer she went to Russia to visit her family before coming back and continuing with the plan to go to Canada and get the student visa. When returning to the US she was denied entry because she had a tourist visa (they said her intentions were to study and not be a tourist, therefore her visa did not count). They denied her entry and revoked her tourist visa after which she went back to Russia and got her student visa there (instead of our original plan of getting it in Canada), which she now has for 5 years.

We do want to settle in the US to live permanently. I do not work yet as I have also not yet finished my education but I do have a home and lots of family in the US.

I am still unsure if its safe for us to go to the US now and study, will we have to leave again if we decide to get married after she gets her degree?(on a student visa she can only stay there as long as shes a student right? so only one year) and what goes into maintaining the green card?

Again, I apologize for the confusion it has been very difficult for us as things in the US are very strict and complicated compared to other places.

You can go on the student visa. She can study. You can marry in the US on a student visa. Then figure things out.

All this was pertinent and you just asked a very general question. If you don't want to tell a forum then ask a lawyer.
