Older American woman in love with younger Algerian man

I am not sure if I am in the right area to discuss this topic but I am new to this site and in need of advice. I am 40 yr old woman in love with a 22 yr old Algerian man. We met online and have been talking for awhile now. Despite what anyone would think, we actually have a lot in common. He is an amazing person and I love everything about him. We want to be together but I am not sure how we even start that process. Any suggestions? Thanks.

Hi Purpled, I'm very happy you found someone special. I'm also older than my fiance, so I know how it is :) First step would be to meet him in person. This is a requirement for the fiance visa. You must have at least met in person once within 2 years of filing for the petition. When you meet, please keep everything such as receipts, plane stubs, etc. because you will need those as proof when you file your petition. Go the appropriate regional forum and the Embassy reviews for his Embassy and read up on the potential problems that may arise.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes, you have to meet him first !!!

If that goes well then check out the two paths which are available for you to get him to the US if you want to have him move here permanently. That is what this site is all about. You could do the K1 fiancé visa or the CR1 spouse visa. Check the comparison between these two on the "guides" tab. Be aware that if you go this route you will have to eventually file an "affidavit of support" to show that you can financially support him here in the US. Good Luck !

Hello Purpled. :) I'm 7 years older than my fiance as well, we have had no issues but Argentina is an easy country, and we qualified for everything perfectly. :)

You have two options:

K1 visa

  • Typically takes 5-8 months until you can move to the U.S.A. This is sooner than the CR-1 visa.
  • Fees are greater in the long run.
  • Once you're in the U.S.A. and married, you'll have to file for an Adjustment of Status (AoS) to get a green card (GC).
  • If you want to work while waiting for your GC you'll have to file for your Employment Authorization Document (EAD) or work permit and your Advance Parole (AP) with your AoS, this can take an additional 3-6 months before the EAD and AP is granted (will not effect the AoS processing).
  • If you've been married less than 2 years when you are granted your AoS you'll have to apply to remove conditions in 2 years, which is additional fees and paperwork.

CR-1 Visa:

  • Can take upwards of a year before you can move to the U.S.A.
  • Fees are less in the long run.
  • Once you enter the U.S.A. you get your green card and can start working immediately.
  • If you've been married for more than 2 years at the date of entry to the U.S.A. on a CR-1 visa you will not have to apply to lift conditions.
  • Check Administrative Processing for your country via your country portal for more details.

Thank you for all your advice. I am planning on going to visit him in April. I have heard a few things. Is it hard for American woman to get a visa into Algeria? I have heard this is difficult to do. Also, I have heard that it is harder for older woman and younger Algerian man to get approved. Is this true? What we have is real. We love each other and want to be together. I have no doubts with him. He is honest, caring, an amazing person. I want to know how hard of a fight its going to be for us to be together. We are ready for it and we are not going to give up.

I don't know if it is difficult for an American woman to visit Algeria, but apparently any American needs a visa, so google the Algerian Embassy in DC and I am sure that you will find what you need.

Many women on VJ are significantly older than their husbands/fiancés and have been successful in getting their fiancé or spousal visas. Same advice as couples with no age difference......document everything, photos with time/date stamps, records of communications (email logs, Skype, telephone, snail mail letters and cards). This type of evidence will eventually be required to prove the "bona fides" of your relationship. Check the guides here and you will find even more types of evidence which you can submit. The fact that you are a little older may invite a little more scrutiny by the consulate, but if your have your evidence in order they can not deny on the basis of age alone.

The journey will be long, especially since you will not even meet him until next April, but if you are prepared it will not necessarily be hard.

Its not difficult for you to visit him and when you do, I hope you'll also meet his family and if possible take a few pictures together. Make your decision on the visa after you've met each other and see which one fits best. Would you move to Algeria? Ask him what he thinks about it (if you're serious), then closely study his reaction. Best Wishes!!
