On July 26th my fiancee and I were approved for a K-1 visa from the USCIS. An approval notice was mailed to me by US Mail on the same day. It's been a month and two days later and I still have not received the notice approval yet. I called the USCIS and they said file a I-824 to get a duplicate notice set to me, but this form has a $405 dollar filing fee. The embassy has already received the case from the National Visa Center. I'm confused on what to do now. I don't want to pay $405 dollars to the USCIS for a duplicate approval form, especially since I paid them $340 dollars to get the process started already. Has anyone ran into this problem ? This is not right !!!! Should I not worry about the approval form from the USCIS ?

you'll need NOA2 hardcopy when you do AOS.. nd try to talk with Tier2 in order to file I-824 since you never recieved NOA2 you dont need to file or pay anything..

The same thing happened to me. I have a thread about it. Basically, got approved on July 25, NVC received and transferred to to Consulate on August 7. We emailed the consulate for packet 3 and received that on August 14. We returned packet 3 on August 16. I emailed the consulate on August 27, and was advised that the case is in the que to be assigned a interview date.

Keep in mind that while all of this was going on, I never received a NOA2 from USCIS. I had called them 10 days after we got the txt/email on july 25, and was advised that it could take up to 30 days. ON August 23 however, we received another txt/email with the following:

On August 23, 2013, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

We did receive a letter from NVC that our case was transferred on August 07 to the local consulate.

Ok, I received the same letter from the NVC on August 22. I guess that is all I need.

yh thats the notice of Action but you need its hardcopy once you recieve it thn keep it in a safe place you'll be required this at the AOS time.. nd tell Tier-2 to re-send it to you since you never recieved its hardcopy in mail

Yes it's two different forms. You should have received an approval notice (NOA2) from the USCIS. I haven't received mine either ! I'm very annoyed with the whole process.

its just notification alert regarding your case which you already got via your email-mobile that you have been approved.. you are supose to get its hardcopy nw

i had the same problem before. my husband and i NEVER received the hardcopy of NOA2 as they call it here on visajourney. but our petition process continued. our case was forwarded to NVC then to the embassy but we never got the hardcopy of NOA2 (notice of approval form). people say you need it for the beneficiary's AOS ( adjustment of status) but you know what... we did not submit that form when we applied for my husband's AOS. what we did.. we set up an appointment via infopass to speak with an immigration officer and he told us that the notice of approval form is not that highly important as long as he has the passport stamps showing his entry to the U.S.

what we did for my husband's AOS is that... we sent a letter saying "we never received the hardcopy of the notice of approval but we received an email notification saying our petition was approved". then we sent them a copy of the email and then a copy my husband's passport entry stamps and a copy of the letter we got from NVC saying they received our case and that it is approved. Guess what? we just got a letter yesterday saying my husband's AOS is approved and his greencard will follow within the next three weeks. so yah, don't worry too much about not receiving NOA2 hardcopy as long as your petition is moving and getting processed on your fiance'/fiancee's end.
