Need more information. Did your mom and you come here on a K1/ K2, she got married, you both got the 2 year greencard, and then she got denied the Removal of Conditions for a ten year card? Why did she get denied?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hi! My mom filed a form I-751 but it got denied. So my question is, will I still be able to file a greencard renewal? And if I do, will I get a 1 year extension letter? Thanks!

What does the denial notice read? Unless the reason(s) for the first denial is/are taken care of ..... USCIS will deny her ROC again!

Yup that is exactly what happened. she got married, has the 2 year greencard, and got denied. They have a lawyer working on it right now though. I just wanna know if I can still apply for renewal and will get the extension even though she got denied? Thanks!

I would think yes, as usually, once you have the greencard, your greencard is independant of your mom's.

The exception would be if they question her whole visa- ie if they are now saying her K1 was gotten fraudulently, then there would no no legal status for you to get a greencard and then ROC.

The ground of your visa are based on your mom's marriage to USC. However provide the following information to get better suggestion.

1. Let's know why you were not included in your mother's I-751. Did you enter after 90 days of her entry? How old are you now?

2. What was the actual reason given by USCIS in denying your mother's I-751?

3. Do you live with your parents?

USA

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.
