Hi everyone,

i just got a quick question: a friend want to petition for his wife and child.The child is 4 years old,does he need to file separate petition for both of them or just one including the child.

Thanks for your replies.

06/15/2016-- N-400 sent.

06/17/2016-- N-400 received.

06/23/2016-- NOA received in mail.

07/12/2016-- biometrics

07/11/2017-- Interview

Just one petition including the chid.

This is not correct. Immediate relative petitions do not permit more than one beneficiary, so two petitions would be required for a US citizen petitioning a spouse and step-child, or a natural child who has no claim to US citizenship.

ya, if friend is USCitizen, I am dead certain that's 2 petitions, one on each human.

US Citizen and Biologically Child.

Does he qualify to file a Consular Report of Birth Abroad (CRBA) for the child? If so, he will have to file this (and not a second petition) in order to obtain a US Passport for the child (US visas are not issued to US Citizens).

If he does not qualify to file a CRBA, then he will have to file two petitions.

You need to send in another petition for your stepdaughter with a photocopy of the NOA1 from your wife and hope they are put together. If they are not by the time your wife's is approved, you can slow your wife's petition at the NVC until the daughter catches up.
