Hello all.

Im wondering if anyone has experienced this situation. My wifes son arrived on a k2 the same day she entered the United States. He has gotten into trouble with the law on several occasions.I just found out he did not complete his probation for the first time he was arrested because he got in trouble again. I understand that if he is denied she will be as well because thay are on the same application. Has anyone had to reapply for spouse only? Will they even give us a second chance to apply for my wife? How does this all work? I thought if our proof of marriage was strong than his situation would not effect hers. Please help with advise.

Someone correct me if I am wrong, but I don't see anywhere where your wife would be denied if the K2 is. The K1 & K2 AOS are still two independant applications when submitted together. Your wife is adjusting based on being married to you (meeting the K1 requirements), and your wife's son is basing his AOS on his mom. It would be different if you wife was denied AOS, then her son would not have anything to base his AOS on.

You might want to update your timeline, because it looked like you were on the AOS stage still.

It doesn't change anything. Did you submit all the paperwork related to your stepson's troubles (it's part of the ROC criminal history section)?

The two year green catd expires October 20. I have almost everything I need. I have some of his paperwork, however not for his current arrest. He has until the beginning of October to pay the court. So im sure I will receive an rfe since I am planning on submitting the package mid September.
