I-134 Co-Sponsor and/or Joint possible ?

Hey,

Quick question. I appreciate that this has probably been asked a million times (Sorry I did search but couldn't find any thing)

My US sponsor has a fairly new job. The way she gets paid is complicated.

Her guaranteed income is currently below the poverty line.

If she earns her above guaranteed income, every dollar she earns she keeps 50% (She is a Dog Groomer) Even tho she has had a few good weeks, she is still fairly new, so her income stream is still not stable, beyond her guaranteed minimum, some weeks she would earn enough to get past the poverty line, some weeks she does not.

I am guessing we need a co sponsor, I am thinking about her asking some people even if she is just there, just to make sure.

Can it be a joint sponsor ? Her son lives with her, and there incomes combined would go past the minimum, or is the only option a co sponsor ?

If only co sponsor is allowed, I assume, she would do the form 1-134 for her self, and any co sponsors would fill out the same form and provide the required evidence? (Can a co sponsor be a friend? I am thinking we could ask her daughter in law but she is out of state and only been working 2 months herself)

I'm starting to really worry about this scenario as we don't have a great deal of people to ask, any advice would be great.

I ask this because AoS form I-864 has a I-864a version that allows joint sponsor, this isn't the case here?

OK, I just read this. Is this true ?

"No. You need to show income in the country you stay. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline."

That is true for certain consulates. Some want the 125%. You can contact the one you will interview at and ask if they require 100% or 125% of the poverty level when using an I-134 for the K-1 visa.

There is no combining of incomes with the I-134. If you need a co-sponsor, you need one that meets the requirement for their own household size plus the foreign fiance(e).

Thanks, I am in Canada, so I will guess I will call, and hope everything falls in to place before we need to get that done, either she gets a pay rise and or evidence of more income!

If we get a 1-134 co- Sponsor,, during the Adjustment of STatus do we have to use them or can we just joint sponsor then ?

Your co-sponsor for the I-134 does not have to be the joint sponsor for your AOS. If she uses her son for the I-864, then he would not be a joint sponsor though. He would fill out an I-864A as a household member to go along with her I-864.

I am in a similar situation where I am living in the US and don't meet the financial requirements because I am a student and can only work part-time. I found this helpful. The last 3 paragraphs talk about joint sponsors.

I am getting my mom to be our joint sponsor but it says that some consulates don't even care about a joint sponsor because it isn't really binding. What do you think?

Some consulates are more strict than others and will not allow co-sponsors. Some will only allow them on a case by case basis and prefer the co-sponsor to be a family member. Sometimes an I-864 is even asked for from the co-sponsor because they want to have a legally binding contract signed.
