Hello

My wife and I filed paperwork for adjustment of status a month ago, we have since received an appointment for biometrics and everything was fine until we got a letter last thursday titled "Request for initial evidence (I-485)". I am a bit confused as to what they need from me. The letter says

1.Submit all supporting tax documentation (W-2s, 1099s, and all supporting tax schedules) submitted to the Internal Revenue Service (IRS) from the petitioner/sponsor on Form I-864, Affidavit of Support, for the most recent tax year

2. The household member on Form I-864A, Contract Between Sponsor and Household Member provided a different address from the petitioner/sponsor on Form I-864, Affidavit of Support and/or is not listed as a dependent on the petitioner/sponsor's Federal income tax return.

Please submit evidence that the household member listed on Form I-864A, lives at the same address as the petitioner/sponsor or was listed as a dependent on the petitioner/sponsor's Federal income tax return.....please guys help me how I should do

Need some information to help you.

Did the USC sponsor submit their 2012 tax transcript or a complete copy of their return with their I-864 as required to begin with? Are they self-employed?

Who is the household member that filled out an I-864A? Why are they not at the same address?

Hey I only submitted my sponsor tax return without W-2s and my sponsor is my sister in law, we don't stay in the same house, I only stay with my wife, I don't understand them when they ask me about the same address or is it a must to stay with the sponsor at the same place?

Okay, if you use a copy of the tax return instead of a free IRS tax return transcript, then it must be complete. You must send all forms, schedules, attachments, W-2s and/or 1099s. You do not have to worry about sending a complete copy if you use the IRS transcripts. They are preferred > http://www.irs.gov/Individuals/Order-a-Transcript

If you used a joint sponsor that does not reside with you, then they needed to fill out their own separate I-864, not the I-864A. An I-864A is for a qualifying household member that resides with the USC primary sponsor. You had your joint sponsor fill out the wrong form. Have the sister fill out an I-864 and include a statement that you mistakenly used the wrong form and are now providing the correct one for your joint sponsor. Make sure the joint sponsor included all their supporting documentation too, like their 2012 tax return transcript and proof of income such as a letter from employer and/or recent pay stubs.

This is good info. Also do not forget to send them proof that the co-sponsor (your sister in this case) is a US citizen.

Yes I do not know what letter you are meaning. You need to provide a complete copy of the USC sponsor's tax return or an IRS tax return transcript, and the joint sponsor needs to fill out an I-864 form and supply any supporting documentation that may not have been sent to begin with, like I stated above. There is no letter to write. Just make a cover letter to list what you have included and put a simple statement on the cover letter that you mistakenly used the I-864A for your joint sponsor and your joint sponsor has now provided an I-864.

I did my biometric on 09/04/13, I replied my RFE and they received it on 09/11/13, my status charged to Request for Evidence Response Review. How LONG will take for me to get my EAD or any other reply from them?
