Hello

We just filed the AOS from F1 student status through marriage. I was showing my On campus job as affidavit of support since my USC wife is unemployed. Will that create any problem ?

I submitted the following things. Did I miss something?

I-130 (Petition for Alien Relative)

  • G-1145 e-notification of petitioner

  • I-130

  • Check in the amount of US$420

  • Passport-size photo of beneficiary & petitioner – 1 copy each

  • G-325A of the petitioner

  • G-325A of the beneficiary

  • Citizenship certificate of petitioner

  • Bona fide of marriage

    • Marriage certificate

    • Utility bills of June, 2012 & July, 2013 under both names

    • Rental leases of 2012 and 2013 under both names

    • Proof of co-mingling of assets

      • Confirmation letter from Bank of America

      • Confirmation letter from Chase bank

      • Citi-thank you preferred credit cards with recent activity

    • IRS joint tax return transcript, 2012

    • Letter from petitioner’s father acknowledging marriage

    • Petitioner listed as beneficiary in beneficiary’s payroll

can I please know who is sending the documents? Petitioner or beneficiary ?

We did joint filing. So we have both of our names ( Petitioner + Beneficiary) in the cover letter. Is that a problem ?

No , actually that make sense. Infact, we are also going to do joint filling. But My question is sending it . You or Petitioner ? I guess the person who send the documents will get notifications from RFE .

I see. We actually have both of our names on the USPS package.

Don't know why we submitted two G-1145 thinking one for I-130 (petitioner's name ) and one for I-485 (beneficiary's name). I hope I didn't complicated my case and hope USCIS just pick either of us

Timeline

The petitioner filed the I-130 and the beneficiary files I-485, I-131 and I-765. If you are sending them all together, I don't think it matters who's name is on the return address :)

This is what we submitted. Basically you need to have few things in the letter as the USCIS says

1. D.O.B and Place of birth of the person

2. Address

3. Relation with the Petitioner/beneficiary

RE Bona Fide of Marriage: Letter from relative acknowledging the marriage and co-mingling between the petitioner and beneficiary

To whom it may concern:

My name is FIRST LAST. I was born MONTH DATE, YEAR in COUNTRY. Currently I am a citizen of the United States, residing at ADDRESS, STATE.

I personally know the petitioner, FIRST LAST, and the beneficiary, FIRST LAST, as they are my daughter and son-in-law. I know that they were married last year on DATE in MARRIAGE PLACE.

I know that FIRST LAST married FIRST LAST in good faith and they live together as husband and wife in CITY. My wife, mother of the FIRST LAST, has visited them at their CITY residence sometime ago in YEAR.

I declare under the penalty of perjury that the foregoing is true and correct.
