DS156 and 156K

Hi guys. I was looking at DS156 and DS156K and I got few questions.

- On question number 36 : Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?

Should I click yes because my fiance filed I-129F or no cuz it refers to any other petitions ever filed before

this one ?

- The only one that I should leave unsigned (should be signed in front of the consular) is just the DS 156K,

right?

- The DS 156K needs an evidence of our engagement. We did not hold a formal engagement ceremony or

anything....so, how important is this proof?

Um...sorry if I am repeating questions.....and thanks a lot.

Nov 16th, 2006 Sent I-129F to VSC - overnighted

Nov 20th, 2006 NOA1

Dec 4th, 2006 NOA2 !!!!! Dang...that was fast.. thank you GOD....

Dec 12th, 2006 E-mail from NVC : Petition forwarded to US Embassy in Jakarta, Indonesia

Dec 14th, 2006 E-mail from US Embassy in Jakarta : Packet 3

Jan 08th, 2007 Medical exam! --- Done! Dunno the result tho......... =/

Feb 06th, 2007 Sent packet 3 back to the Embassy with DHL!!!

Feb 15th, 2007 Packet 4 (By phone...)

Feb 22nd, 2007 Interview date!! - VISA APPROVED!!!!!

Apr 15th, 2007 POE : Detroit

May 04th, 2007 Barefoot wedding at Hutchinson Island, FL

May 09th, 2007 Applied for SSN

May 18th, 2007 SSN Received

June 9th, 2007 AOS + EAD paperwork sent

June 15th, 2007 NOA1 for AOS and EAD

June 18th, 2007 CHECKS CASHED (for both AOS and EAD)

July 10th, 2007 Biometrics Appt.

Aug 02nd, 2007 AOS transferred to CSC

Aug 22nd, 2007 EAD card production ordered!

Aug 29th, 2007 Greencard production ordered!!

Aug 31st, 2007 EAD card received

Sept 7th, 2007 2 Year Greencard received

June 24, 2009 I-751 sent (Priority Mail)

June 29, 2009 NOA 1

No unless someone filed before this one. Look at the example form.

Correct, the DS-156K is a Sworn Affidavit, much like DS-230 part II So it needs to be signed infront of consular officer.
- The DS 156K needs an evidence of our engagement. We did not hold a formal engagement ceremony or

anything....so, how important is this proof?

Prepare a new letter of intent, from both Beneficiary and Petitioner.

- What gives you the impression that the question refers to other petitions filed before the current petition?

- Not sure what the procedure is at your consulate. My wife signed only her DS-230-I in advance, everything else at the interview.

- Your word on it, and your actions, is generally enough evidence of engagement. As YuAndDan mentions some consulates like to see a written re-affirmation of the petitioner's intent, especially if the petitioner is not present and a long time has passed since the petition was submitted.

Yodrak : I dunno.... it just came up in my head. So....do I have to click yes or no? I was told to click no before....what do you think? And uh... DS-156 should be left unsigned also? Er...what does it mean whe they tell you to have it in duplicate...are you supposed to copy it before you sign both of them or should you fill out another form so that they both have different bar codes? .........sorry if i sound stupid.....but better to ask now than sorry.

Detty,

If a petition has ever been filed for you, select 'yes' and provide the information. (Note that this question does not have the same significance that it would if you were applying for some other type of non-immigrant visa, or that it would if you'd previously applied for a K visa.)

I don't know if the consulate you are dealing with expects the DS-156 to be signed in advance or at the interview.

The issue of submitting I-156 in duplicate is interesting, now that the form must be filled out electronically. I think that I would fill out the form electronically 1 time, then photocopy the printed form so as to have 2 paper forms to hand in at the interview in accordance with the instructions you have. (The same as I would have done before they went to the electronic version with bar code.)
