CR1 NOW Include Evidence of Bonifde Marriage w I-130?

If your lawyer is recommending minimal evidence because of what USCIS requires, and isn't considering the crucial consular phase, he's short-sighted indeed.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I didn't send in and received an RFE but was very fast after I sent it

I read something on visajourney that says: "Note: Evidence of a Bonifide Marriage

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:"

I asked my lawyer about this and he said that is not required and is only required if they ask for it. I asked him if I should prepare afidavits or something else but he said that a copy of the marriage certificate and a translated one should be good enough.

Does anyone have any actual experience of NOT including evidence of a bonifide marriage when filing the I-130?

What do you guys think?

Of course I would love to trust him, but I just want to ensure that there are no delays when filling.

So I talked to my lawyer and expressed my concerns. He said he has done over 100 of these and has never had a RFE.

He said he will include a little of the evidence I want to include, but he said usually the evidence is part of the second step of this process.

Does this sound right to you guys? I am putting multiple pics on a page with word, scanning marriage cert, translated version, honeymoon airfare stubs, hotel receipts and that's about it. Hope its good enough.

He said I am paying him to do this for me, not to explain why he is doing it.

What do you guys think?

Need to No. Its not needed or required. Some of us wrote out a relationship timeline. But thats all up to you.

Very important question about this part of the petition. will we need to send a letter explaining how we met, our relationship as it happened, where it was our wedding and stuff? is it important to write that! Someone already sent it? THIS IS A VERY IMPORTANT QUESTION!

This might be termed an 'evolution of relationship' letter or a 'timeline letter' and usually is submitted with the I-130 when it's known that the country for the interview is pegged as 'High Fraud' by the Department of State.

If that's not the case for your country, I'd not worry about it.

Sounds like my lawyer would say...

I am stressed as well due to similar situation except my I130 is already submitted with just copy of marriage certificate. So now praying really hard....

Over course of dealing with immigration lawyer, I would say, it's your application and you can be a little firmer about what you want submitted. Don't just politely ask for advice but say you want such and such to be included in your package. You pay him and he should at least have that in consideration. It's not like you are omitting stuff or asking to put stuff that goes against you. I don't say include a book, but some evidence can't hurt. I wish I'd listened to my own advice. I should have learned from past experiences that sometimes lawyers screw you up with their "I know more" attitude. A lot of people's experience can't be wrong....

For me...all I can do is wait. For you, ask that he include some more stuff so that you are comfortable as the I130 form does state that evidence of bonafide marriage should be included....

Can't say I have had positive results with immigration lawyers who say they 'specialize' in I-130. Many have given incorrect information or are not even aware of updated policies and procedure.

Agree with all. Your applicaition, your life and he does what you say. period.

Over course of dealing with immigration lawyer, I would say, it's your application and you can be a little firmer about what you want submitted. Don't just politely ask for advice but say you want such and such to be included in your package. You pay him and he should at least have that in consideration. Please I'm in the same situation. My husband submitted our petition with no evidence just the marriage certificate. So please tell me, what did they request of you. And how did it go? I'm super worried and need to hear from you asap. Thank you.

The member to whom you're asking your question apparently hasn't logged in to VJ for over a year, so a response is unlikely.

If the evidence that your husband sent doesn't satisfy USCIS, he'll receive an RFE. He'll have chances to add material to the file at that time and also later in the process. There's no need to super-worry.
