Time Limit to Send Packet?

Hi Everyone,

According to the DoS website, Montreal has received and logged our case today (only 2 days after NVC sent it!). I was wondering, is there a time limit in regards to when we need to send Packet 3 by? I don't have it completed yet and am trying to delay making the interview date for a little bit due to serious health issues with my mom that may conflict with me going to Montreal (I'm from Oshawa, ON).

I know the NOA2 had an expiry date of November 30, 2013, but I think I've read here that those dates don't count for K1 applications? Unsure.

Also, what is the average wait time for the interview right now?

Just trying to get a good judge about when I'm going to need to be able to do this. We almost canceled the visa when we found out my mom might have cancer, but decided to let it proceed and just hope everything works out within the 6 months after approval (hoping we are approved, of course). It's just complicated the whole process of timing it all, though.

Dec 29th, 2013 - POE together <3

Jan 3rd, 2014 - Married!

K1 Visa total time: 241 days from mailing i-129F to visa in hand.

AOS Timeline:

Apr 26th, 2014 - I-485 Package sent to Chicago Lockbox, including EAD and AP applications

May 1st, 2014 - NOA1 received for I-485, EAD, and AP

May 27th, 2014 - Biometrics appointment

Aug 12th, 2014 - Interview & Approval

AOS total time: 109 days from mailing I-485 to approval.

ROC Timeline:

May 24th, 2016 - I-751 Package sent to CSC

May 26th, 2016 - NOA1 receipt date

June 3rd, 2016 - NOA1 received in mail

July 28th, 2016 - Biometrics letter received, appointment for Aug 12th

July 29th, 2016 - Biometrics completed after walking-in early

Once you make an interview appointment the NOA2 expiration doesn't matter but it does before then. You can extend the expiration by 6 months if needed I believe. You can always rebook your interview as well or book it further ahead if needed. Most people try to book a sooner date, not a later one so you should be okay booking further ahead.

Thanks so much! I'm glad I asked and didn't just ignore the expiration date. I feel a bit better knowing the interview date can be flexible and I may be able to get an extension.

Our earliest available interview was 77 days initially from MTL logging packet 3, which took ~8 days from when they received it.

So don't fret, they're slow.

If you sent Packet 3 via XPressPost September 2nd, they would get it Tuesday and sit on it until at least September 10th before you would receive Packet 4 via email. 80 days from September 10th is November 29th, which would be a reasonable "earliest available". You could likely find an interview date in December or January as well.

Even still, you can always sign back in and head over to the appointment calender...which would cause you to lose your November/December spot and make you take a later interview. I wouldn't press my luck much with that strategy without the blessing of the consulate.
