which visa for my daughter

Dear member,

Now im progress K1 visa for me and K2 for my daughter, the problem is my daughter will follow me next year not this year and now im still waiting for my interview date with usem and hopes i can go to usa next month.

Yesterday i just found out our lawyer not apply K2 for my daughter and they said i need to apply K2 next year when my daughter ready to enter usa. In this point im so confused as i will be married soon and why still K2? I think it should be CR2? Or any advise any visa i need to apply for my daughter...

A k2 can follow the K1 by up to a year after the K1 enters. Otherwise she will need an I130 from ( how old is she if under 18the your hubby can file and it will be faster )

This will not be over quickly. You will not enjoy this.

Nigeria is correct. As long as she follows within a year of your visa date, you apply for the K2 when she is ready to go.

is mean is till can apply k2 for my daughter and my daughter only need separately interview?she is still 11 years old..

if more than one year i need to apply I-130?

do i need attending her interview next year? and if i apply K2, i must apply AOS for her and all the procedure will be the same just like what i will do after getting married?

and if my hubby apply I-130, we dont have apply AOS instead she will get GC 2 years?

You can apply for her K2 visa within 1 year of your K1 visa being issued. - You do not need to to do the I-129F with her. Just immediately file for the K2 visa as she is a derivitive of your approved I-129F petition. The process will not take 6-7 months. You can immediately apply for her K2 visa at any time within that year.

If it beyond 1 year your husband will need to send an I-130 petition for a step-child to the USCIS. Yes, she will need a K2 interview. You can attend her interview and fly home with her. I'm unsure if you can have a trusted family member do this for you instead. I would think your daughter would want to have you there.

Yes, you will have to have her AOS if you do the K2 route. If you were filing for the AOS at the same time as YOU the cost for hers is only $635. However if she comes after you, you have to pay the entire cost minus the biometric fee. (http://www.uscis.gov/i-485)

The cheapest route for you is to get her K2 visa ASAP and have her adjust her status at the same time as you.

Thankyou for your info :), your explaination is more better than the attorney paralegal we hire :)..now i know what to do to get visa for my lil daughter :)..

If it were me, and my daughter wanted to live in the USA, I would bring her over ASAP. My daughter is 10, but she wanted to stay in Canada with her father. I didn't have a choice about where I lived as a kid so I wanted to give her a choice because her happiness means more than my wanting her to be with me. You will miss her more than you can imagine if she stays behind. Trust me. Thankfully my daughter is only a 3 hour flight away though (20 hours of driving) so I can visit her quickly if there is an issue.
