Yes-its Me Again-DS3032 Question

Hi everyone- A couple questions I was hoping you all could help me with. I just got a Packet from the NVC in New Hampshire. Its the Affidavit of Support Fee Bill. I understand that i need to send them 70 dollars but they also included a copy of the DS-3032 that they stated they will be sending to my wife in the Philippines. My Question is this- Does Marie appoint me as her agent? Or not? Whats the "norm" thing to do? We arent using an attorneyof any kind. If she appointed me as her agent would everything including her Packet 3 and 4 come to me instead of her? I guess im kinda confused now-doesnt the Embassy send Marie her Packet 3 and 4 ? or is it Packet 3 they are sending her now (which will include the DS-3032). Or does she get packet 3 after she returns the DS-3032?

Aug-24-2006 - Back home to the U.S. Again. Leaving this time was by far worse than the last.

Sep-03-2006 - 1 year since Marie and I met online

Sep-18-2006 - NOA1 for the I-130 received in mail

Sep-27-2006 - I-129F sent to Chicago

Oct-04-2006 - NOA1 for the I-129F Received in mail

Oct-12-2006 - Email from USCIS - I129F transferred to California Service Center on Oct. 11th

Oct-18-2006 - Email from California saying they received my I-129F for processing

Nov-02-2006 - Email from CRIS(early afternoon) -I129F approved

Nov-02-2006 - Email from CRIS (late at night) - I130 approved

Nov-06-2006 - I129F and I130 NOA2 received in mail-Hooray!!!

I sense that perhaps you may not have a clear understanding of the situation and what your options are.

- Your approved I-129f petition should be at the consulate by now, has your wife begun her K3 visa application?

- If so, do you plan that she will get the K3 visa and come to the USA as soon as she has it?

- And if so, do you plan that she would adjust status in the USA or return to the Philippines to interview for an immigrant visa?

If she's going to do the K3 and adjust status, she should return the DS-3032 stating so and asking the NVC to return the approved petition to the USCIS, appointing no one as her agent, and you should not pay the I-864 processing fee.

Hi Yodrak-Thanks for answering-its always a pleasure to have you help me. Anyway- Yes the consulate has the I-129 petition but Marie hasnt received anything from the Embassy yet. This is our plan Yodrak- we are going to try the K-3 Visa but there is some question as whether or not they are going to accept the fact that my Brother is Maries sponsor.I had a long lay off which eventually turned into a company shutdown so my income didnt quite meet the guidelines. The previous 2 years( 03&04) were fine for me and 2006 will also be good so I will be sending Marie a I-134 from me also,including a letter from my employer and check stubs,etc,etc...First she will try my Brothers Affidavit-who makes the Big Bucks and if the agent asks for mine - she will have it in a seperate folder ready to show him.Were hoping they will issue her the K-3 and if they do we plan on her coming to the US right away. But!!-In case they dont- we want to still have the CR1 Visa left for us as an option. I talked to a rep at the Embassy and explained the whole story to her and she said I should try the K-3 and if it doesnt get approved we can continue on with the CR1. Thanks again Yodrak-like I said -its always a pleasure to hear from you. Maybe you can give me your opinion on whether or not you think we are doing the right thing by trying for the K-3 and also continuing on with the CR1- I know it will cost more money but I would pay anything if it means Marie can come home. It sounds like you are prepared. I was originally going to pursue both K3 and CR1 till the end, no matter the cost, but at this point it really looks like there would be no point pursuing the K3 (for us that is). Good luck with your wife's interview!!

01/01/07 - NVC generated IV Fee Bill (postmarked 1/17 though!)

01/03/07 - returned AoS Fee Bill via Priority Mail (James' shortcut)

01/15/07 - NVC generated AOS package

01/22/07 - received IV Fee Bill - overnighted back to NVC same day

Thanks for the clarifying details. I was wrong, you do have a good handle on the situation. So Marie will be wanting submit the DS-3032 to go forward with an immigrant visa application. A reasonable decision in your circumstances from what I read.

In that case, the decision on an agent depends on how you think the communication channels will be the most reliable or quick, whatever your priorities are, and who you feel most comfortable about filling out the forms - you or her - recognizing that her signature is needed either way. My sense is that many VJers in your situation would opt for naming you the agent for Marie.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
