CSPA/Over-aging question on F2A

Then that would be August 1st then, when all F2A visas became current in the system. That buys us an extra two weeks in the worst case that the F2A retrogresses behind his priority date in October... I think. Because according to CSPA, his "age" will turn 21 on October 21st... if I'm reading this correctly.

If that's the case, that means we're safe and do not need to stress out on when the NVC will receive the case and assign it a case number.

As long as his PD is current, he has until July 31, 2014, to file the DS-230.

If the current PD in the F2a category retrogresses to 10/15/12 or earlier, then CSPA may not protect him. By the time it becomes current again, he may have aged out. SO GET HIS DS-230 IN BY THE END OF SEPTEMBER AT THE LATEST.

Hi,
I'm a LPR (not a citizen yet) and sponsoring my daughter
We paid AOS and IV fees and are trying the best we could to file DS-230 to lock CSPA, but I need your help on determined when my daughter F2A aged out to F2B.
Background info:
- Kid's DoB: 4/09/1992.
- Filed I-130 sometime at the end of October 2012
- Receipt Day: Oct 24, 2012
- Case #: WACxxxx
- Priority day: Oct 22, 2012
- I-130 Approval Day: July 15 2013
- On Aug 7, 2013, we received a letter from NVC:
The immigrant visa petition recently filed on your behalf is now eligible for further processing at the National Visa Center (NVC). You will need the following identification numbers to carry out the next steps in the immigration process:
Your NVC Case Number: HCM201371xxxx
Your Invoice I.D. Number: xxx
Your Beneficiary I.D. Number: xxx
Category: F2A
- Right now even though we haven't file I-864, I-864A and DS-230 yet, we paid those fees already.
The questions I have are:
1/ Please correct if I'm wrong: My impression is we have one year from the Priority date to get the DS-230 to NVC's door and the deadline is Oct 22, 2013, which is only a little more than one month from today 9/10/13.
2/ Can I submit the DS-230 package for now to meet the deadline and my daughter will bring the Original Police Clearance to the US Consulate on the interview day?

3/ What day is used for CSPA, the date we filed I-130 or the date I-130 was approved? If they go by I-130 approval date, my daughter was about 3 month past 21 year old. And should I write a letter to NVC to explain that my daughter is the last member in the family and she's not married blah blah..?

Don't use form DS230, this is no longer accepted by NVC. You have to fill up DS260 online for beneficiary visa application. Also, you have to mail the supporting documents for your DS260.

Thanks. I was about to say this since I clicked on my IV payment and I was transferred to DS-260 so I realized that the form I need to fill out actually is DS-260. But thank you very much for replying.

Here comes a new thing to me but not for other members: Submit AOS I-864 package (including all the supporting docs) via email instead of mail. I gotta figure out how to send all the file at once or break that big package into a couple emails.

My impression is once DS-260 was electronically submitted, we can follow up by email all the supporting docs just like the I-864 package. The original docs will be brought in the interview day at the US Consulate.

The AOS I-864 will be emailed from the petitioner's email and the DS-260 will be emailed from the beneficiary's email.

Hello,

Have a quick question about our son's case and how it relates to the timeliness of the priority dates being current until next month. We are LPRs trying to get him in the country under an F2A Visa with a Priority date of October 16, 2012. As luck would have it we received the NOA2 a few days ago, notice date set to August 19, 2013. I believe the case will be sent and processed through the NVC as the Priority Dates on the Visa Bulletin are current (is this correct?).

Again, since the priority dates are current, I believe that he should be covered under CSPA regardless of whether or not the NVC finishes processing the necessary paperwork? Here are our via http://cspasolution.com/

That being said, if we file the DS-230 and I-864s as soon as we receive the case numbers from the NVC (which should be in a few weeks?), will he be covered by CSPA from being moved to F2B? If we get all the paperwork in time before October's retrogression, what would happen to the case if NVC doesn't finish processing the paperwork or schedules an interview until after October? Is there any way we can expedite the case? The thing we're really worried about is if he ages out to F2B.

As far as i know your son is safe he was covered with CSPA, as long he was underage when your Case Approved no matter how long his Visa Arrive. In my situation my Family case was approved 1989 im still 7yrs old, but our PD got current Feb 2004 few more months b4 im turning 22. Then we got caught with Retrogression. I got my Visa May of 2005 which im already 22. Most interviewer in POE told me i was Lucky Girl... And Im very Thankful To GOD or else i'll be left alone in my Country

Since I didn't use OPTIN from the get-go, I just email NVC directly to see if I can now email AOS & DS-260 supporting docs instead of mailing them. Let's see what they say.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
