Why should a visa be denied?

Wow I got a big let down today. Got a letter with denied but an appeal letter attached. I called the USCIS for answers because it was unclear as to why. Looked like a RFE paragraph. We provided the information + in our first RFE. The guy at the office asked me to read him the letter and said it was realy unclear. Both my Fiancee and i are upset by this. Is this a common thing to happen???? Have others had to deal with this issue. I am going to appeal and include more information but need help in finding what i need to provide for them. Thanks for any help

I'm very sorry to hear that. I can't imagine how crushed you must be. My most sincere condolences.

I'm pretty new at this but, if this were to happen to me and I did not understand what had happened, I would spend a couple hundred bucks consulting with a lawyer -- at least until I had a handle on why I had been denied and what my options were.

Just my $0.02.

Our Timeline

08/03/06 -- Met online, have chatted almost every day since then

09/29/06 -- Met in person at the Lima Airport. 10 wonderful days together.

10/31/06 -- I-129F mailed to TSC

11/09/06 -- CSC cashes the check

11/14/06 -- NOA-1 Received

11/16/06 -- We get 11 days together in Arequipa (Betty's home town). I meet her family for the first time.

12/28/06 -- We get 19 days together in Arequipa. I'll be back in February.

01/18/07 -- Touched! First sign of life.

01/19/07 -- 12:10 AM, NOA-2! APPROVED!!!!!!!!!!!!! On to the next step.

01/19/07 -- Touched again, around 11 AM. I guess we're on the way to the NVC!!

Can you type what the letter says in here? Maybe the folks here could help you figure out what went wrong and what you need to do. Just don't include your EAC reciept number, last names, addresses, and other personal information like that. ;)

2/28/07: Interview: approved! (Day 99)

4/15/07: Married, in a noreaster (Day 146)

6/20/07: AOS, EAD, and AP mailed

6/26/07: NOA1 (Day 6)

7/14/07: Biometrics (Day 24)

7/23/07: Recieved AOS RFE (dated 7/17) for W-2s, mailed them out the next day (Day 33)

7/27/07: RFE response received, processing resumed (Day 37)

8/14/07: AOS transferred to CSC (Day 45)

8/21/07: CSC received/is processing AOS (Day 52)

8/29/07: Welcome notice mailed! (Day 60)

8/31/07: Card production ordered! (Day 62)

9/11/07: Greencard in hand! (Day 73)

I'm pretty new at this but, if this were to happen to me and I did not understand what had happened, I would spend a couple hundred bucks consulting with a lawyer -- at least until I had a handle on why I had been denied and what my options were.

Just my $0.02.

Dont worry...not uncommon for them to do that. Call the USCIS and speak with a supervisor..

they can reverse this....wait for responses from senior members I am sure they will be able to

give you proper directions

Here is what the letter gave as the reason. When i called I was told that i needed to submit a criminal bakground check after reading them the letter. The background check is no problem I will give them one

However sufficent evidence was not submitted regarding did you meet your fiancee or spouse through the services of an international marriage broker as had been specificaly requested in the request for evidence"

Your visa was not denied. Your I-129F petition was denied because you did not fully respond to the Request for Evidence regarding whether or not you met your fiance through an international marriage broker. This is not a very common occurance, especially since the IMBRA requirement is new.

Not sure if you can get another copy of the RFE, answer it and return it to them or if you need to file a totally new petition. I would call USCIS again and ask them this question specifically since why it was denied is clear.

I will scan the letters in the morning and post the whole thing ....except for personal info. We sent in our case in June and waited called called checked called and waited . Got the RFE tried to include as much additional info as possible ...and get this in the mail today......no email BTW

Hmmmm!! sent in a long letter explaining were and how we met with. What is the definition of a marriage broker? Is yahoo or the others considered IMB's

nope, yahoo's not. go to IMBRA forum or search for imbra topics, ull find out what ur looking for.just send the RFE asked, my fiance did it and found out no problem. My fiancee always called the center before he sent it, making sure everything's correct.he didn't send the RFE if he's not sure of the things asked and the answers.He is that perfectionist, we are if we are aiming for the success of this visa journey!

Seems very clear to me that you didn't answer the IMBRA question on the form. I would go back to your original RFE that they sent you and send them another form completely filled out.

2006-07-01 : I-129F Sent

2006-07-11 : I-129F NOA1

2006-09-18 : I-129F NOA2

2006-10-16 : NVC Left

2006-10-21 : Consulate Received

2006-11-10 : Packet 3 Received

2006-11-11 : Packet 3 Sent

2007-02-14 : Interview!!! OMFG!!!
