I've spent the past seven months working hard to bring my wife here; we had some issues while separated, yet she finally arrived on a K3 visa two weeks ago.

To date, it has been almost a complete disaster (no communication, no intimacy of any kind, only pressure to do the AOS for the green card).

I believe that I've been played; while it hurts, I really want to know what my options are.

I'm of the mind to go straight to immigration and state my case; is that what should be done? She should go home and live her life, yet I also want to be sure she doesn't do this to anyone else and that she gets plenty of time back home to think about what she gave up.

I would really like to document this as a fraudulent marriage and make sure it sticks to her immigration record.

Thank you in advance.

Cheers

I should probably add a bit more detail; I've been reading some other posts.

The issues started a few months back, where I was getting little communication, other than requests for money. I had a feeling there was another man in the picture somewhere.

Her family members confirmed that there was somebody she was close to, perhaps to close with, and she would be talked to about the situation (in other words, clean up her act).

OK, red flag; I know this and honestly believed that once she got here on the K3 things would be better.

They didn't get better and have actually gotten worse the past two weeks since her arrival.

I coordinated the stuff for the AOS and submitted it; yet after having done this, several things came to light.

I found out she was indeed in love with another man, may have had a child by this man (left at home), was having conversations about getting her green card and leaving me and I'm sure some other things I haven't found out (did I say communication was bad between us).

In other words, I've been lied to many times and have been played in order to gain access to this country and obtain a greecard.

I desperately want to head this off and make sure she leaves the country and goes home. I also want to make sure she doesn't play some other poor soul.

Thank you!

Report it...that is all you can do. In addition, if you have the funds...get a lawyer quickly....she may try the ol "he beat me" #######. Be very careful.

This could only be the tip of the iceburg...get yourself checked out at the clinic....be wary that she might be carrying a child (maybe the others persons).

I am just throwing out all kinds of things that could also be going on....not sure...just throwing it out there for your analysis.

If you don't get a lawyer...you must write a full report about the whole situation, have it notorized and sent to DHS or whoever.

Watch your back because if you don't...they will do it for you.

You can request to withdraw the AOS submission you endorsed (communicated to both the Service Centre over your juridictiona nd the local office), noting that due to information that has come to light in recent weeks, the marriage will be terminating. And yes, be careful not to set yourself up in a situation, altercation or opportunity which could be used in a VAWA claim.

 I am sorry to hear that about you. When people committ marriage fraud to gain entry into the United States it makes it harder on the people who are true in their intent. I would withdraw that petition and file for divorce.

You may want to discuss with a lawyer as well. I wish that I had done this sooner, when I suspected fraud. The burden of proof is likely upon you to prove fraud. But if it is, it's possible that the marriage could be declared null by a judge and your "spouse" would not have any claim to maintenance. This all depends on divorce laws in your state. You've already signed the affidavit of support, haven't you? If so, you are probably on the hook for that, but again maybe not if a judged declares the marriage invalid.

Good luck.
