My wife and stepdaughter had thier GC interview today and i asked why do some

people get approved without interview ??? :wacko: He said that was not true .... I said

yes it is , especailly from CSC ... :blink: He said no way, every one must have an interview ... I let it go and let him have the last word... ;)

Oh this makes me laugh.. and just think.. these people have our lives in their hands....

It is actually very very scary at how little and how much disinformation is circulated, it makes me wonder just how involved their training programs are.. even with the constant changes to all the visas and AOS procedures one would think that more than the one person would know what is going on!

I got the same reply, about it not being possible to have your AOS approved without an interview and never bothered insisting it was the case, when I rang the mis-information line, guess they were just living up to their reputation.

I see good and bad with not having the interview straight up, some people can't get things like bank accounts, insurance etc sorted out in the time it takes, specially if the SSA is being a pain about issuing a SSN, as is the case with me. On the other hand it just makes it sooo much easier for the fraudulent cases.

Even though I am one of the transferees, I think that we all (CSC Transfers) should have an interview for the removal of conditions, plenty of time then to show that a life has been built around the marriage.

I don't think it's technically illegal to waive the interview. The law says:

8 CFR Sec. 245.6 Interview.

Each applicant for adjustment of status under this part shall be interviewed by an immigration officer. This interview may be waived in the case of a child under the age of 14; when the applicant is clearly ineligible under section 245© of the Act or 245.1 of this chapter; or when it is determined by the Service that an interview is unnecessary.

To me it makes more sense to have the interview at the lifting conditions stage as that's pretty much the point of no return. It also gives a couple more time to establish themselves and gather evidence to document their life together.

It is probably a good thing to remember that the people at USCIS have tremendous amount of power over other people's lives. It is probably not a good thing to confront them when you are needing their help. Just know that this agency is extremely powerful and interprets the laws pretty much as they see fit.

I agree with you, but right now we have no evidence that they actually will require interview to lift conditions.

That said, nobody getting a 10 year green card that I know of has got one without interview.

They come in and interview people all day until quiting time. I think it is perfectly understandable that they do not know the policies of the California Service Center. I really don't expect them to come home and read visajourney or the AILA web site. Remember that for them this is just a job.

I think it is better for them to conduct as many interviews as they can each day and ignore what is going on at the national level.
