Hi all, i just recently got NOA2 and the embassy gave my fiance the packets, everything is ready except my affidavit of support because i went to my bank so they could get me a statement for the embassy and its been 10 days now, first time the stupid clerk didnt get it for me the first time i asked for one and now that 2nd one has been sent but its been 6 days and i havent received it yet. So my question is, is this going to cause any problems for my case?? Because altogether its been almost 3 weeks since my fiance received the packet, the translater told him to send me the affidavit by mail so it took afew days for me to wait on that and i didn't know what kind of evidence they were requesting. I hope this doesnt cause any problems because i have everything ready, im just waiting on that bank statement.

Unless you don't meet the 125% poverty requirement on your income it's not required. If you read the I-134 form instructions it states: " Evidence should consist of copies of any or all[/u]...... failure to provide evidence of sufficient income and/or financial resources...." If your income is below the 125% poverty line than you need to supplement it with assets from bank sources as a form of support.

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the need for the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

We just got our packet 3 from the US Embassy in Bangkok and it lists some requirements for the affidavit. The instructions they sent indicate you need to send two of the following to substantiate your information regarding income and resources.

1. Notarized copies of latest federal income tax return

2. Statement from employer showing salary, length, and permanency of employment

3. Statement from an officer of a bank regarding bank accounts, date open, and present balance

4. Any other evidence adequate to establish financial ability to carry out olibation for support for an indefinite period of time
