Hi, VJs

1) My K-1 petition is valid till 10/10/2013.

Now, I'm preparing forms like I-134 and etc.

I just want to know that period till 10/10/2013 is for medical check up, Embassy's interview and visa only, right?

I'm having trouble in preparing I-134, so can I go interview near 10/10/2013? The 90 days is counted the period from when we got visa but not before 10/10/2013, right? I'm really nervous and sometimes, I even can't breath. I'm in big trouble. The expire date is nearer and I'm having trouble preparing I-134. What should I do???

2) My fiancé(USC) is living in my country without having any job. Then, he also doesn't have paycheck or tax form for recent years. He doesn't know how to support me. So, my elder sister wants to file I -134. But my sister doesn't know that she needs to file I-134 for my fiancé or me or for both. Please advise me. Or Is there any link or reference we can look up for Co-Sponsor, like my sister to me???

HELPPPP! I know my questions are a little bit confused because I'm already confused. We are so scared that we'll lose this petition because the expire date is nearer. Helpp please

Thank you so much.

Help!!!

The I-129F petition approval is good for 4 months, and this can be extended by contacting your consulate should you need to make your interview appointment past that time. Once the K-1 visa is approved, you will typically have 6 months to use it to enter the US. After you enter the US, you will have 90 days to get married.

If your consulate accepts co-sponsors, then the USC petitioner fills out their I-134 and provides their supporting documents and the co-sponsor fills out their own separate I-134 and provides their supporting documentation. The co-sponsor must be a USC or LPR and reside in the US. They need enough income to meet the requirement for their own household size plus the foreign fiance(e).

Relax, the Embassy has the ability to re-validate the petition if an interview has not yet taken place.

Ok so lets say you sponsored I864 for 2 people before so do you have to include them in your household for the i134 or just you and your fiancee ?? Then it is % 100 or % 125 the PG for the i134

Help!!!

There is no validiity to the petition. That date is meeaningless in the K-1 world. The NVC can hold the case for as long as they wish and so cant he Embassy. You're getting worried over nothing. There is nothing you need to do but get ready for the interview.

If the I-864 is still in effect, as in those 2 people have not given up their permanent residency, have not worked 40 quarters, have not become US citizens, or have not died, then yes they will be included in your household size. So, if it is just you and your fiancee, then it will be a total household of 4 with the other 2 you sponsored before.

Many consulates want to see 125% even with the I-134. You would need to research about Haiti to know if they will accept only 100% or not. Each consulate is different. It is best to have 125% though, since you will need 125% for AOS and the I-864 fairly soon after the K-1 is granted.

One more thing , do you use the same guidelines table for your co sponsor ? , lets say for exemple if I found a family or friend willing to help that has no dependent so it would be him/her plus my fiance , and should make $18912 or more.........

If the co-sponsor has no dependents, then yes, it would be a household of 2: the co-sponsor plus the foreign fiance(e). Household of 2 needs at least $19,387 > http://www.uscis.gov/files/form/i-864p.pdf
