Question about joint co-sponsor I864 (merged)

I earned $202 last year, but I was told I am not required to file taxes. I would write them a letter of 2 lines stating what you mentioned above and sign it.

Then my joint sponsor, my mom, has to file in I-1864 with me as well.

Now my question is my mom has met and is above the requirement of poverty line for the minium specified for the year 2009 , 2010, 2011.

But for 2012, because she was sick she had not worked for 6 months and only filed for taxes for the 6 months she worked her income was 12,000k gross 9000. She clearly does not meet the guideline for the poverty line for year 2012. But now she is self-employed and starting working again since march 2013 and pays tax quartely with a income of $2500 monthly income.

Sponsor size should be looking at line 2 ? or line 3 or minimum household? I was told by a rep it is 2 but just confirming. As it is me , my mother, and my spouse.

So will that year 2012 will be an issue?

What is the best way to tackle this situation.

My brother has worked in 2012 as well as has made 21k and gross 18k and now has lost the job. Should I have both of them be the joint sponsor as well all live at the same household to meet the poverty guideline for 2012?

I am confused...please help...

neither your brother or your mother qualify to joint sponsor your wife. Current and previous should meet guidelines. Some embassies current. But Current has to be their for their household size plus your wife.

neither your brother or your mother qualify to joint sponsor your wife. Current and previous should meet guidelines. Some embassies current. But Current has to be their for their household size plus your wife.

I thought she needed $24, 412 to meet the requirement?

And can't I inlcude a letter for last year saying she did not work last year and include any asset such as a car?

I don't know what you mean your "brother is not part of the family"?

You asked if your mother or brother can joint sponsor and the answer is no because He has no job and she didn't make the guideline last year. You can try. But because she was sick last year what if she doesn't make the guidelines this year.

Some embassies don't weigh previous year as much as others. But its a risk.

If its just your mother plus your wife she needs to make $19334 for 2 people.

I believe Pakistan is pretty strict on previous and current you may want to check around your forum look in interview reviews to see what they look at.

Do I need to add another joint sponsor for 2012 and it will take care of the year 2012 as she is working now?

Or can I include the car as an asset to compensate for 2012 even though it was recently purchased worth $15 k?

A self employed person's current income will be found on line 22 of their 2012 tax return. If it's a new business for this year, then there's no income until it appears on their 2013 tax return filed sometime last year. Past income is past income but current income is how one qualifies to sponsor an immigrant.

She is not "working" as in "employed". She's "in business". You would be wise to find one qualified joint sponsor.

The joint sponsor's household size includes self, spouse and dependents on their most recent tax return, plus the intending immigrant. You are not in the joint sponsor's household size unless claimed as a dependent on their tax return. Sounds like Mom does not currently qualify. I would look for somebody else.

You do not use assets to compensate for a lack of past income. Assets are used to cover a shortfall in current income. A car can only be used if there's another car NOT being used, then only the equity in the car can be used.

I am claimed as a dependent on previous tax year 2009, 2010, 2011 and 2012. She pays quartely tax for being employed in the business. Can she not attach a letter stating that she is currently self-employed and earns X amount of $ per month . I thought I read that proof of current employement do help ? Is that not ture?

So it will be line 3 ?

She has 2 cars? They are family cars.

She was employed in the previous years with year 2012 being able to only work half the year. And now she is self-employed. I don't know of any other person that would take such responsibility :(

Your mother counts her household plus the immigrant. Her household would be herself, her spouse (if she is married), any children under 21 and any children over 21 who she claims on her taxes, along with anyone else she is currently sponsoring (yourself I assume?)

Evidence of employment is required for the employed. Your mother in NOT employed. She is self employed. When you switch from employed to self employed, you effectively have NO INCOME until it appears on line 22 of an annual federal tax return. She has not yet filed a tax return for this self employment so, would currently be considered to have ZERO INCOME at this present time, no matter what she says on her quarterly tax filings.

Your mother doesn't qualify based on current income, no matter what past income she had. You need a qualified joint sponsor. She isn't one.

I didn't see the deleted post but expect the deletion had more to do with HOW you said it. Clearly, the fastest and cleanest way to sponsor an immigrant occurs when the petitioner has adequate employment income. The OP has said nothing about their own "current income" from any current employment. Obviously, for the petitioner to find a job, with adequate income is ALWAYS a viable solution.

With this being a Pakistan case, expect that just meeting the minimum is not going to be enough to satisfy the Consular Officer, particularly if the petitioner is not currently employed.
