I also want to know if I screwed myself over by not filing right away.

Because I thought this would just be a silly like a few days or 1 week out injury, no biggie.

But he's been out for 3 weeks now and MIGHT be able to go back next week so that will be a total of 4 weeks ago.

I seriously didn't want to do all this ####### for some stupid sprain that he got only TWO DAYS after he started but he didn't do anything wrong, he's been in pain all this time and the poor guy has been stuck in the house every day, his insurance is refusing to cover his left fingers for the next 5 years because of it, I keep having to leave work early to take him to the doctor, and I'm out the money that we were SUPPOSED to be bringing in so I don't really have a choice.

Rant:

I don't show up at work at 8 30 and my phone is ringing off the hook............

Ok, since every state have different requirements. The first thing you need to do is yahoo workmans comp for Illinois. See what kind of forms they require. And the timeframe that it is/ was required within.

That is what I am B*tching about.

None of these forms or the website make sense.

What are the time limits for notifying the employer
of a workplace accident
?
Generally, the employee must notif
y the employer
as soon as practicable, but no later than 45 days
after
the accident. Any delay in the notice to the employer can delay the payment of benefits

I read that weeks ago

ok, so what do you want to know? if the employer doesn't respond. You file a complaint with the worker's compensation commission.

they will contact the employer. No one wants to pay out. That's what gave rise to the profession "Workman's comp atty, and personal injury Atty"

Holy #######, I just went to the Illinois workers comp web site. I can understand being confused. Did you start with the initial report of injury?

No idea where you go from there.

I'll help you with this. (What I know of NY anyway)

I read this as Steve has had practice and trying to deny injured employees workers comp, and has seen how they get around him. idea9dv.gif

OK chicagklar. If you PM me with the details of what has transpired up until now. I can see if I'm of any help. And if I'm not. I'll call my shyster friends over at a law firm that does this stuff.....

Yes, the incident report was filed with the manager on duty the same day.

From what I understand on the site, the company is responsible for doing that, which they did.

Not a bad idea. You sound like you worked your life to be able to take that, so yes!

I want to arrange a weekend here:

Ok, then?

So the part I'm not understanding is "petitioning the arbitrator" when they don't pay up

This is the form that comes up and it makes NOOOOOOOOOOOOOOOOOO sense
