Since you went to bed at 8:56 pm my time, which will be like 3:56am Tokyo time...

In NYC, someone who resides at a premise for 30 days or more AND has requested a lease is a legal tenant. Then he becomes difficult to evict, even if he doesn't pay rent

And why does NYC have such law?

IMHO it's kinda stupid...

I emailed my buddy. It could end up with murder! Apparently the Catholic Buddhist borrowed a couple of hundred bucks, borrowed my friend's best dress shirt, and went of to some bar, tipping the bar tender 20s. My friend is livid that the loser didn't hand in the shirt to the dry cleaners.

Next time he does that, your friend should change the locks! And leave the house for a night ;)

remember that little bonus system I talked of? where we pick up someone's electrica bill, or car payment? for doing extra stuff, stayin late, etc.....he took that away too.

but you know, serves these a holes right, no one wanted it when it was there. Now that it's gone, they wanna b1tch about it.

NYC is retarded for landlord-tenant laws. Start with reading NYC administrative code 26-521

Yeah I don't sleep much during the week. My friend is going to give the loser a date to leave. He was pissed off that the guy mentioned his girlfriend was coming over from Germany to visit him ( and he hasn't told her he was evicted from his NY apartment), and insinuated he wanred her stay at my buddy's apartment too.

My friend was hoping the guy would get on his own two feet within a week. But the guy has mental problems it seems. He is a master carpenter, but doesn't have tools. My friend offered to loan him some money to buy some equipment, but then the guy started complaining that he couldn't work unless he had at least 8 hours uninterrupted sleep a night. He complained about my friend entering the kitchen in the middle of the night and waking him. My buddy told him to try and find a cheap share apt in Queens, but the guy doesn't want to share as he is convinced he will be raped buy a random room-mate.

My buddy advised him to get a bar job, in the inter-rim, but he won't because his grandfather was an alchoholic. For a born and bred New Yorker this guy doesn't get how the city operates. He creates obstacles. Yesterday he was in court, because he was held by gunpoint by an ex-cop (and it wasn't even a robbery) He must have said something.

My buddy is always picking up strays ( humans and animals ) He must thrive on this nonsense . He is a lapsed Catholic and I am sure deep down in his heart he is a wannabe priest. This Catholic Buddhist dude ain't worth saving!

once past 30 days, he will be known as a "holdover" tenant. granted the tenant'd have to prove that he has lived there for 30 consecutive days. like with something addressed to him at that location. etc...

but why let it get that far?

at this point, your friend can still legally just simply throw him out. Change the locks for instance. Once past 30 days, if the bum knows the law, and you change the locks on him. He can call the police.

The police:

If you let him back in, you'll be issued a summons.

If you don't let him back in, you will be arrested for unlawful eviction.

IMHO he is stalling... Just like Steve said, after 30 days of living in your friend's house, he will be able to stay there forever. For free! And I think he knows that.

wait....don't jump the gun. Granted even if he is there for more than 30 days....once in court (Landlord Tenant court), he'd still have to prove several prongs....

1- that he was there lawfully, which he is. (and not a squatter)

2- that he has stayed there 30 consecutive days. (credit card bills sent to that location, dated letters, etc)

3- That he has requested a lease (verbally, or written)

But for the Police, all he has to do is say that he's been there more than 30 days, the police has to take his word for it. (just like if you flag down a cop, point to a person, and say "he hit me and took my money", that constitutes "probable cause" to arrest)

And it'll take weeks to get into landlord tenant court, and months to evict. (6 months is reasonable according to NYC guidelines)

Now this is true for NYC, not the rest of NY state....

we ARE talking about NYC, yes?

He is going to say his sister is visiting from California and that he has to move out by that date.

There is not much of a safety net in NYC. My buddy predicts this guy will be sleeping outside on the steps of a church, and get arrested for vagrancy. Wow! Lots of f¥ck-ups in NY. He claims he can't contact his old Wall Street stock borking buddies for a job as they are all in prison at the moment.

the bum can reach out to "Partnership for the Homeless" they'll direct him from there. Seldom does anyone get arrested for vagrancy in NYC. (btw you gotta have 3 bucks on your person in NYC, otherwise it's vagrancy).

Lawyers will be provided for the bum-gent courtesy of.....I think NYC housing court "volunteers" dept.
