I do not meet the income requirements for I864, so I am using my mother's income to sponsor my husband. Does my mother need to be a "joint sponsor" (we live at the same address) and fill out the I864, or can I just use her income so that I am the only sponsor and have her fill out the I864A? If my mother does file the I864A she is required to provide proof of the relationship and that we live at the same residence. What type of evidence shows this? Birth certificate, etc? Thanks -Jessica

Hi Jessica-Yes, she does have to fill out the 864A, which you must sign as well.

You must also fill out an 864 for yourself- but remember to add her to your household's size as another member because you will be using her income combined with yours.

If memory serves, she will be required to send in her birth certificate or passport to show citizenship. By signing the 864A, you are both signing a legally binding contract and will be swearing that she indeed does share the same residence.

Best Wishes !

Jessica,

Your mother can be either; as you choose.

A birth certificate would show that you are related by birth to each other, so that is one step.

How can you prove you live in the same household?
