Hi,

I have submitted my I-130 for my wife using my last name even though at that time her passport still used her birth name. We were thinking that we could get the last name changed before the Consular Processing to use my last name in US (Another reason for it is because she doesn't have a last name). But we found out that it is very difficult to do so in her country and now her I-130 has been approved.

What should I do? Should I cancel the current petition and re-file another one? Or should I amend the petition and if so, how can I do it? Or should I just ask her to go for the consular processing and explain the situation there hoping that they can update the system over there? Do I need lawyer in any case?
