We sent in our massive set of documents via our lawyer on Feb 27th, and when I looked up the current wait time for I-130 for US citizens filing for spouses, they were on Oct 22, 2012......so roughly 10 months. Have there been significant delays in the process? I keep looking every where online but the most recent cases I've read about were in 2011..anyone have any info on this?

Oops on my part if this has already been discussed, I just joined the forums and so please excuse me if I'm acting ridiculous. :D

Most likely it's the sequester slowing things down. Plus it's the end of the US govt fiscal year (new year for them starts Oct.) So while the USCIS is completely funded off of the fees, that doesn't mean that the FBI or anyone else they use to help with background checks etc, weren't affected. It should speed up now a little and more come Oct. But inevitably it will slow down from end of Nov until after the holiday season.

Very comforting. LOL. I gave up on worrying. All I achieved in the last month worrying about is lack of productivity at work and increased usage in coffee and ibuprofen.

The reason no data is because its been a year now (August 15, 2012) that all I-130 starting going to NBC then from there the local USCIS office where the petitioner lives.

Some offices are faster than others. I know between August and January it was approval under 60 days. Since January it has greatly slowed for all offices but again it depends.

It's a long time to wait, that's for sure. Edited by Ozz777

If the local office is Atlanta.... I can see why it would take so long. They're so backed up it's crazy.

Thanks for the info....although it sounds like we've just got more waiting to go....well, I didn't expect it to be quick and after the frantic bit of getting our first packet together, we've been able to move on with our life. I guess I was hoping it would be around the stated 5-6 month wait. :(

The files are not always sent to the local field offices... Alot of people on VJ are dead set on handing out that info...it is a possibility but its not always the case. My attorney told me that files WERE being sent to the field offices if they needed extra work. Not all cases get transferred there. ( and I'm not saying he knows everything)

They are opening that new service center in Kansas.. Everything goes to the NBC, then they will determine what to do with the files...

( I think they are training the new hires to adjudicate cases... but that is just my opinion)

Most people who call and speak to a tier 2 rep are getting 12 month processing time now. My lawyer insists that the USCIS is still on track with the 6 month processing time. so, with that said.... it is what it is. It takes a long time and there really is no rhyme or reason. When I filed back in 2008, I waited 10 months for a K-3 approval which was suppsoed to be much faster back then... Well, it wasn't and I did everything I could to get an expedite and I called the senators office regularly.

My suggestion; make an inquiry with your congressional office. it doesn't do much ( you'll get a form letter stating a 12 month processing time) but its better than sitting around doing nothing while you wait. Hang out here and read the threads and fill out your timeline. You'll be able to see the approvals for the month you file. As long as everyone comes back and fills in their timeline, the info will be more accurate

ok, i'm 13 months into waiting, still NOT approved, no requests for any missing info and I have senator and congressman involved. waiting to speak to a tier 2 was not worth my time....I even had our first baby alone. just don't be in a rush to expect anything approved...long wait times do happen and I never thought I would be one of them. so if they say 6-9 months this is an average-some get it quicker and some wait longer

Feel free to contact the Ombudsman about ANY complaints. Also if a tier 2 is rude to you, I would ask to speak to their supervisor. There has to be a way to complain about rude customer service. Maybe a new company would be hired and trained PROPERLY if there were enough complaints.

Also try calling back and speaking to someone who is nicer and more able to answer your questions. Sometimes you have to call 5-7 times and take the most frequent answer from the "misinformation line."

Remember though, these are call center people, they are not the people working on petitions. They're an outside, contracted company, not direct gov't employees. They most often will not put in a service request until at least 6+ months.
