I need advice.. we are in a pickle..

Hello,

I need some advice. I am american citizen and my fiancé is an Italy citizen. We have been together for over a year. Our initial plan was to file for a K1 visa while working in Italy for the summer season, however our situation changed. I become pregnant, while we were in the usa visiting my family. We returned to Italy and at first planned to get married and have our baby in Italy. However I was very concerned, due to the process my fiancé has to go through, for our baby. I want our baby to have america citizenship. So I decided to come back to the united states. My fiancé is still in Italy working and plans to come over in October. The issue that I'm worried about is having the baby in december and then my fiancé has to leave in January because he can only stay 90 days legally on his visa. I do not want another separation and the baby will be way to young to fly or I would leave with him. I'm looking for a quick and legal solution to this problem. I would really appreciate any help or advice to resolve this situation. Our initial goal is to get him a green card and try to make a life in america..... I have researched all the visa's and researched other websites. I know its almost impossible to avoid the separation, but if we weren't having a baby then we could deal with the separation. Did I make a mistake coming home. I have thought about contacting a lawyer, but i know it can be expensive. I really need advice and if there is action we can take before he comes to america that would be smarter.

I would say that the K1/CR1 are your only options at this moment and neither of them are probably as quick as you want them to be. Though I will say that the K1 is a tad bit quicker than the CR1 but the CR1 gives him a green card out the gate.

Your child can have US citizenship no matter where they are born, look up CBRA . It seems at this point that a CR1 is the best option to get him here and working but you will still be apart.

This will not be over quickly. You will not enjoy this.

You could go back to Italy, provided you have adequate health care and are there legally, and have the baby there then file for a CRBA. During such a time you can do the CR1 visa after marriage. Then you both could come back with your family.
