I had come into the country on K3 Visa in October 2006,before I could adjust my status,my wife/(the I-130 petitioner)filed for divorce and in Jan 2007 it was finalised. After it got finalised,I got married to my present wife( 6yrs and counting) a US citizen and we filed another I-130,it got approved and my classification was changed from K-3 to IR-6 in 2009.when we filed the I-130,we also filed I-485(adjustment of status) and when we went for the interview,it was denied by the immigration officer and then he went ahead and placed me in removal proceedings in 2007.My Visa was meant to expire by 2008 and since I was in removal proceedings without knowing the outcome of the case,I had to stay behind and continue going to court till the judge reached a decision which was arrived at about 3 months ago.I was given voluntary departure and presently I am out of the country but before I left,I filed form I-824(notice of action) on the approved I-130 with my present wife and they said my petition was being forwarded to NVC.

While here(Nigeria) we kept contacting USCIS and NVC because the notice date was March 18 2013 and processing time was 3 months but by the time I left in July 2013,there was no further update from USCIS which prompted us calling regularly and after pestering them for 1 month,NVC contacted USCIS with regards to my file and they had to contact NRC (National Records Center so that they could locate my file which they finally did and I got an email on the 9th August 2013 stating that my approved I-130,pending I-485 and I-765 were being transferred to NBC.Now I went to my portfolio and all the cases are on initial review but that is confusing because if my I-130 was approved in 2009 but put aside because of removal proceedings, why is it still under initial review and the cases being sent to NBC,will it make the process time faster or what exactly is going on

Thank you for your response

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

Now you wait for your interview date. You can call DOS in a week or two and call now and than just to stay on top of it. Usually is about 2 to 4 months maybe wait.

Congratulations on the re-affirm.

Would the OP need to do document intake at the NVC because they've started all over or would they just get an interview because the I-130 was reaffirmed? I would think there would be document intake at the NVC level?

Thank you for the question.was thinking about this since it said it was re-affirmed but would like to know about that aspect also for i would believe that would be the major difference in how long I would have to wait to get a date

2 quick and important questions

1: Would the OP need to do document intake at the NVC because they've started all over or would they just get an interview because the I-130 was reaffirmed? I would think there would be document intake at the NVC level?

2: Got a bill for AOS(adjustment of status) will I be getting another bill for DS-3032?

Thank you for the response
