Long Time Between Wedding and I-130 Submisson

My wife and I married in 2007 and I'm just now submitting the I-130 package. Is this going to cause me problems?

The reason we waited so long is: First I was moving around and wanted to wait until my residence was settled. Then, she got pregnant and we thought it would be better for her to be with her family so they could take care of her during the pregnancy. Her family are well off and have a nice home. I was living in an area in which I didn't know anybody and I lived 90 minutes from my work, and we thought it would not be good for her to be alone (while I was at work) and pregnant in the USA. Then, after she had the baby, we were in the same situation. Finally, I started making arrangements for me to move close to my family, so that when they got here, we would have a family support system in place. And that is where I'm at now.

I have traveled to the Philippines once a year for a 2-week visit. We were married in the Philippines and I was there when my daughter was born and was there for both of her birthdays (she just turned 3).

We have a lot of photos of us together during my 2-week trips, which I'll be sending some of those with the I-130. Also, I have copies of phone bills, Skype logs, and emails. We have some letters, but we didn't write that often, because we talked on the phone or Skyped every night.

So, is that fact that we've been married almost 6 years going to cause us trouble? Should I submit a spousal affidavitt of bona fide marrage and affidavitts from third parties as well?

The length of time from when the wedding takes place to the time a petition is filed is not an issue. People file when they are ready to do so. Don't worry about the affidavits, they carry little to zero weight to begin with.

April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Just my opinion, as long as you guys meet the USCIS requirements there might be some questions but should not be a problem!

I don't see a problem. A short "Evolution of Relationship" letter might be in order to go with all the passport stamps showing your multiple visits. Of course, the child's birth certificate will help too. I would go ahead and get the CRBA and US Passport for your child before the visa interview, if you haven't already.

For a long term relationship, those receipts can be a good thing. For a short term relationship, I wouldn't use them though.

Should not be an issue at all... We had 7 years married before we filed... You file for a visa when you and your foreign spouse are ready to live in the USA ... If that is 10 months or 10+ years, does not matter. As long as you can prove an ongoing relationship during that time...

03/21/2009 - I-130 Mailed to Chicago lockbox

11-30-09: GOT GREEN CARD in mail!!!!!!

Citizenship Process;

1/11/2013: Mailed N400 to Dallas Texas

3/11/2013: interview.. Approved

4/4/2013. : Oath! Now a U.S. citizen!
