My wife's sister (family) is a US citizen currently living in AZ. They will be sponsoring us in order to move to AZ ASAP. My questions.....

1. Do we start with an I-130?

2. Do all of us have to submit an I-130? (husband, and two children under 21)

I am interested in all your feedback to help us move forward with this. We are currently living in Canada.

Well for starters, you won't be moving to the US ASAP - the sooner you realize that the better for you.

Your wife's sister will submit I-130 petition for your wife. Just your wife. She will list you and all children you have but that's it. When I-130 is approved, you then go into the line waiting for a visa number to be available - around 10-12 years for most countries.

Probably a year or 2 before your number is current, NVC will be in touch to start gathering different papers and paying for immigrant visa and I-864 online.

Agreed , with the current immigration rules it is a 11 year to 23 year wait for a sibling petition. Any child that gets older than 21 during the wait will not come at the same time if at all. Sibling petition are one of the classes being tossed about as part of immigration reform. The basic thing is to eliminate the class so if you want to file you probably need to keep an ear to what is going on there. If you have another path such an employment or investment it would be quicker.

This will not be over quickly. You will not enjoy this.

What is an investment considered? Is it easier to get your own ViSA then find work down there?

An EB-5 investment visa requires a $500,000 investment at a minimum.

To get a work visa, you need a US employer who will go through the Dept. of Labor certification that no US worker is available and that is why the employer is requesting a work visa be granted to a qualified foreign worker. Essentially, you need a job offer with an employer who is willing to pay for the work visa.

The US does not issue work visas for foreigners to come to the US to compete for jobs with its own residents. That's frankly a stupid national policy, so that's why it doesn't happen this way.

For the average person, all you can do is wait 12 years to immigrate through your wife's USC sister. Unless you got bank or a degree in a science or engineering, this is what you are looking at for immigrating to the US.
