Hi... Right now I am process in of my K1 visa & my USC fiance, along with my visa has also applied for his son's visa who is 19. Both the applications I-129F & I130 were sent in the month of Jan 2013. Mine is approved last month & has been processed further. I am not able to find sufficient information here on VJ for this particular case of I130. Can anybody help me with this regard??? I am a registered member here on VJ but as a K1 applicant. I want to help my fiance & also want his son & soon to be my son too, to be with us very soon. Please help.

What help are you looking for? Considering the timeline, the son's NOA2 should arrive shortly but you really cannot compare the length of time/ process a K1 and a I-130 for a minor son takes.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

What help are you looking for? Considering the timeline, the son's NOA2 should arrive shortly but you really cannot compare the length of time/ process a K1 and a I-130 for a minor son takes.

His NOA2 is 17th Jan & receipt No. starts with MSC. I am not able to track it on USCIS site as I don't know which service center it has gone. Is the procedure same like K1?? Like NOA2, medical, interview etc. I am not able to find out the exact procedure. Is it called K3 visa?

If his dad sent the forms in January, there is no way his NOA2 would be in January too, you probably mean NOA1 (notice of acceptance).

A K3 is an obsolete spousal visa, forget about it, it has noting to do with either of your cases.

MSC stands for Missouri Service Center, also called National Benefits Center.

Hi again... Read everything & now more confused. My fiance is a USC by naturalization. (in 2011). He got a divorce from his previous marriage in 2006. His son left with his mother back to India. After reading the following contents, I have a question. Why he must have filed I130 form???

A U.S. citizen may petition for:

ball.gif A child (unmarried and under 21 years of age)

ball.gif An unmarried son or daughter ( 21 years of age and older)

ball.gif A married son or daughter of any age

A U.S. citizen's unmarried, minor child is considered an immediate relative, does not need a visa number, and is eligible to receive an immigrant visa immediately. Otherwise, sons and daughters of U.S. citizens will be eligible for a visa when their priority date is listed on the Department of State's Visa Bulletin .

The I-130 will lead to a visa, that is why he needs to file.

Unlike other family categories such as siblings or adult kids, there is no waitinglist- ie they will start processing the paperwork for the visa immediately and the son should have the visa within a year of filing. If the son was an adult, he would need to wait several years before they even look at his paperwork.

Thank you so much for the info. should we expect NOA2 for his petition any time now? Will there be any interview or anything which needs some preparation??
