I-864 or I-864a ?

Hello! Hoping to verify what I have found through research on this site.

Firstly I just wanna say UGH I-864 instructions. Very unclear and unnecessarily confusing!

I am filing DCF in Guangzhou for my spouse. I should fill out the I-864 as sponsor, and my mom as the joint sponsor, fills out which?? I think because I'm NOT her household member she should also fill out I-864 and not I-864a?

And what about her spouse? I remember seeing somewhere that the spouse of joint sponsor also has to fill out a form, but I can't find it.

If your mom income alone is enough to sponsor then the father income is not needed even though they file taxes together you wouldn't need his income if the mom income is enough alone and she needs to fill out I-864 also just as you. The only time the father income would be included is if mom don't make enough and she is using her husband income to meet the guidelines then your father would need to fill out I-864a that the only time..

now, if mom and her spouse filed a tax return with 'married filing jointly' status, then the other spouse must to file an additional I-864A. GUZ IV will ask about that, so if'n you don't have it by interview day - expect another months wait. or two.

Yes married filing jointly. So even if she meets the income requirements he still has to fill an I-864a? I trust you, Darnell, but just double checking! I certainly do not want to wait another month after the interview.

That's not how it worked for me in Manila....are you saying China operates differently?

Sometimes it seems like different embassies have their own ways of interpreting or doing things. To be on the safe side it sure doesn't hurt to have the spouse fill out the 864a.
