Names To Use On Forms?

Hi All:

I have several questions in regards to the forms that I am about to submit for K-3.

My fiance' and I got married on November 9, 2006 and I am getting ready to send the I-130 and the documents that go along with it, and at this time I am petitioning to get my birth name changed(First name only). I filed paperwork with a lawyer in September and it has gone through the newspaper and not the Superior court and at this time I have not gotten a new Birth certificate.

What should I do? I have a copy of the petition and the newspaper clippings. Should I use my Birth name that's already on my birth certificate or should I use the name that I have petioned for. I am really confused at this time.

Also, because I am married now, should I use my married name now or should I use my maiden name until I get all of that changed?

Someone please enlighten me :help: . If I have confused you all, please accept my apology.

Timeline

I would use whatever your legal name happens to be at the time of application, because that will match whatever proof of identity submitted. So if your first and last name have not yet been changed, I would use your old ones. That is unless someone else has better advice :) I'm not entirely sure, that's just what I would do.

01/29/07 - DS230 generated (phone system not updated, email response 2/5/07)

02/05/07 - mailed DS-230 to NVC via express mail

02/20/07 - CASE COMPLETE!!

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

Michael's K-3:

09/28/06 - NOA1

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal

I know you should use your married name on the documents because that's your name now. I'm not sure if you should use the name you're changing it to. I'd say your original married name until the name change is complete. Hopefully others will have more clear advice. :)

For surname, use whatever name you want to be known by. From your post it seems that you want to use your husband's surname.

For your given name, I don't know the answer but I'm tempted to say that since you are only changing the spelling of the name by dropping 1 letter you will probably have no problem doing so without waiting for the birth certificate to be changed. Just give name using the original spelling any place asking for 'other names used'. The connection should be obvious.
