Hi my friends,

I am the man with the proxy marriage.i hired a lawyer yesterday and he said to me in ur case,we ganna submit anew I 130,after we receive a letter from Vermont center then I am ganna send a letter to USCIS explaining why we refile again because the marriage was consumed after the dates that they gave us.the problem is,he ganna refile while the old I 130 still existing and waiting for the evidences.is that make sence?

Filed: IR-5 Timeline

You must file the I-130 AFTER your proxy marriage was consumed. Additionally, on the I-130 package, you need to write on the cover letter why you are refilling and that your marriage was a proxy marriage and when it was consumed.

Hi I had same happen me and my wife we filed k3 and ididnt got the visa cause the consulate send the case back to uscis and after long time of waiting uscis asked us for evidence and they told us we can get answer in 45days and that didn't happen its took months and we got denied we asked lawyer and said we can file new case CR1 and we did then we got approval after 6months and when was the time for my interview the officer in the consulate said that our case is illegal cus the uscis put the K3 and CR1 together and the office said I cant decision about that we need send case again to uscis again. im from morocco too the only thing I can tell you is don't believe in lawyers you can start new I130 but believe me im worry u will have same as me and when its ur interview time u will have problem in the consulate. the only advice I can give you and im not sure about it u can ask about here in VJ and lawyers and see ithink is better if u stop the old I130 and start new one but im not sure of that. wish you good luck
