Hi everyone! I have a question about the I-864. I'm filling it out as the petitioner for my husband's change of status here in the states. Since we've only been in the country for about two months we do not have our own place yet and are staying with my parents. I am financially above the125% poverty line requirement, making sufficient money to support both my husband and I, and do not need my parents as joint sponsors. I would like to avoid adding them as joint sponsors if possible for future financial aid and benefits, etc. that we may need. Do my parents need to fill an I-864 form as well because we are staying with them, even though it's temporary and we pay our own bills (aside from rent as there is no rent)?

Thanks for your input. Kind Regards-

No, as you are financially independant you can fill your own form and no need for them to help.

Also, On the household size #21 of the form, I have put the number of immigrants as I'm sponsoring as 1. Then obviously 1 for myself, and the immigrant I'm sponsoring is my husband? It says to put 1 if you're married, but my husband is already the sponsored immigrant. Do I still put one and then make the total 2, or do I just leave it 0? Thanks again-

Yes it says "DO NOT COUNT ANYONE TWICE". p.s. you are using the old form. Only the newest edition is accepted now

Hi guys, so sorry I just have another question regarding part 6 on income and employment of this form. The instructions have confused me a little bit. My husband doesn't currently have a job since he doesn't have permission to work yet and therefore our household income is my income, (which is above the poverty line), until he gets permission to work. Once he's working we'll be sharing our income. I know it says your supposed to include the people in your household in this part, and since my spouse is the intending immigrant he doesn't need ot fill out the form. But do I put his name if he's not currently making any income? Thanks!

No. It states, 'Income you are using from any other person that was counted in your household size.' You are not using his income, as he has none.
