Co-sponsor just backed out for my partners k-1 visa

OP - remind your cousin's husband, gently, that the I-134 is not a legally binding document, and the duration of 'coverage' is only 90 days , the duration of the I-94 issued at the POE on POE day.

If the cousin's husband is thinking of a long term, 10 year commitment, that's not the case with this document.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

The I-134 is not even a legal document. It is replaced by the I-864 after marriage and when adjusting status. the risk to co-sponsor on an I-134 is virtually none

They can wait until he has a job to file the AOS and the I-864 which IS a legal binding document and hopefully the OP can sponsor himself. Perhaps if this is explained the original co-sponsor would change their mind.

Alternatively the OP can move back to the US now and secure work and sponsor her himself.

I wonder why the form even exists then? I mean it seems like a waste as explained.

Yeah, it does somewhat. But it also explains why some embassies, particularly like London, really don't need to see much evidence or money (e.g. will often take 100% poverty guidelines instead of insisting on 125%, and don't have to see tax returns).

If you see it as just a short-length version of the I-864 it makes sense, since the instructions refer to the same act under "what is the purpose of this form?". It's literally for exactly the same reasoning, just for less time, because the K1 is such a temporary status.

If I remember correctly assets (like a house) counts as 1/3 when showing that you have enough money. If the house is worth 3x 125% of the poverty level then you should be OK and not need a co sponsor. When my wife sponsored me we didn't use a co-sponsor. Instead we showed that we had at least $60k in a bank account.

Thank you for your support and understand during this time of stress for us. You really know how to help people out when they're seeking solid advice. Keep your criticism to yourself when you don't know the whole situation, me or my CIVIL PARTNER. I wouldn't have to be going through a K1 visa if the US recognised my relationship as marriage. I had to move to England at a the cost of seeing my family and have been here for 8 years. If you think I'm selfish you can go crawl back under the rock you came from.

I dont expect anything from anyone and if you don't have any good advice or something nice to say just "Shut It"

Even with a cr1/ spouse visa you are required to have a joint sponsor if you cannot do it on your own, it has nothing to do with whether or not the US recognizes your "civil partner" relationship. Fiance or spouse, you need an affidavit of support. The only option you have if you cannot find another joint sponsor is to come ahead of your fiance and secure a job that fulfills the at least the minimum income requirements. Most of us have had to be separated from our partners, my husband and I we were apart for 10 months until his visa was approved. At least your fiance is from a visa waiver country and there is a good chance they can at least visit you while awaiting the approval of the k-1, that wasn't an option for us as my husband isn't from a VWP country. Keep us updated, I wish you the best.

Thanks to all off you with the sound advice minus the criticism of thinking I'm whining or thinking I'm being selfish.

I do fully understand the visa process and the difficult task of being approved for a visa. I was a bit off because I thought this site was full of supportive people that would just give me some sound advise without casting aspersions at me without knowing my history.

In the mean time a family member has agreed to co sponsor, however I will be making plans to move back to the US prior to interview time (next march?) to get a job and sponsor my partner myself.

I was just really disappointed and shocked because I was told yes no problem, to sorry I can't help. It's no problem now though. I'll sort it myself, like I have always done.

Thanks again to the people who advised without judgment. Too those who found it necessary to add their two cents to try and scold me, shame on you. I do so fear for the lack of humanity in this world.

The I-134 is a convenience form, like a pre-printed check or pr-printed "post-it" note. It has exactly the same legal capacity as a post t note.

It is used by many visa applicants, not just K-1s. It is not required and you can write your own "affidavit". It is even a misnomer to call it an "affidavit" as it is no longer notarized, it is not even an "affidavit" it is a cover letter for the documents showing you can support someone.

there ARE NO guidelines for approval and approvl falls entirely on the opinion of the offier reviewing youcase at the consulate. The "guidelines" are for the I-864. Many, but not all, consulates use those as a "guide" for the I-134 but there is no requirement to and no requirement for any financial support information UNLESS the consulate wants it.

It is an entirely subjective decision.

You can leave first and secure a job. Most of us have to live apart because bringing a partner here is an expensive task. Thinking that someone should take on this responsibility while you enjoy life on your terms is a bit selfish. If you don't have enough positive value in your house to sponsor then get a job. A affidavit of support is a serious document that most intelligent people wouldn't sign for anyone other than spouse, child or parent
